The Committee further notes that no restrictions may be placed on the right guaranteed under article 21 other than those imposed in conformity with the law and which are necessary in a democratic society in the interests of national security or public safety, public order (ordre public), the protection of public health or morals or the protection of the rights and freedoms of others.

Article 21 states that no restrictions may be placed on the exercise of the right to peaceful assembly other than those imposed in conformity with the law and which are necessary in a democratic society in the interests of national security or public safety, public order (ordre public), the protection of public health or morals or the protection of rights and freedoms of others.
فتنص المادة 21 على عدم جواز فرض قيود على ممارسة الحق في التجمع السلمي إلا تلك التي تفرض وفقاً للقانون وتكون ضرورية في مجتمع ديمقراطي لصيانة الأمن القومي أو السلامة العامة أو النظام العام، أو حماية الصحة العامة أو الآداب العامة، أو حماية حقوق وحريات الآخرين.

518. No restrictions may be placed on the exercise of this right other than those which are prescribed by law and which are necessary in a democratic society in the interests of national security or public safety, public order (ordre public), the protection of public health or morals or the protection of the rights and freedoms of others.
519- لا يجوز أن يوضع من القيود على ممارسة هذا الحق إلا تلك التي ينص عليها القانون وتشكل تدابير ضرورية، في مجتمع ديمقراطي، لصيانة الأمن القومي أو السلامة العامة أو النظام العام أو حماية الصحة العامة أو الآداب العامة أو حماية حقوق الآخرين وحرياتهم.

(c) The right of trade unions to function freely subject to no limitations other than those prescribed by law and which are necessary in a democratic society in the interests of national security or public order or for the protection of the rights and freedoms of others;
(ج) حق النقابات في ممارسة نشاطها بحرية، دونما قيود غير تلك التي ينص عليها القانون وتشكل تدابير ضرورية، في مجتمع ديمقراطي، لصيانة الأمن القومي أو النظام العام أو لحماية حقوق الآخرين وحرياتهم؛

ولا يجوز تقييد استعمال هذا الحق بأية قيود غير التي يقررها القانون وتقتضيها الضرورة في مجتمع ديمقراطي لصيانة الأمن القومي أو السلامة العامة أو النظام العام أو لحماية حقوق الغير وحرياتهم " .

Any restrictions imposed must be strictly motivated by the limited concerns which are prescribed by law and which are necessary in a democratic society in the interests of national security or public safety, public order, the protection of public health or morals or the protection of the rights and freedoms of others.
ويجب أن تكون الدوافع وراء أية قيود مفروضة مقتصرة بشكل صارم على الشواغل المحدودة التي يقررها القانون وتقتضيها الضرورة في مجتمع ديمقراطي لصيانة الأمن القومي أو السلامة العامة أو النظام العام أو لحماية الصحة العامة أو الآداب العامة أو لحماية حقوق الغير وحرياتهم().

It also recalls that the second sentence of article 21 of the Covenant requires that no restrictions be placed on the exercise of the right to peaceful assembly other than those imposed in conformity with the law and that are necessary in a democratic society in the interests of national security or public safety, public order (ordre public), the protection of public health or morals or the protection of the rights and freedoms of others.
وتذكّر أيضاً بالجملة الثانية من المادة 21 من العهد التي تقضي بعدم فرض قيود على ممارسة الحق في التجمع السلمي أكثر من تلك المفروضة طبقاً للقانون وتلك الضرورية في مجتمع ديمقراطي لصيانة الأمن القومي أو السلامة العامة، أو النظام العام، أو حماية الصحة العامة أو الآداب العامة، أو حماية حقوق الآخرين وحرياتهم.

It further states that " no restrictions may be placed on the exercise of this right other than those imposed in conformity with the law and which are necessary in a democratic society in the interests of national security or public safety, public order (ordre public), the protection of public health or morals or the protection of the rights and freedoms of others. "
وتنص أيضاً على أنه " لا يجوز أن يوضع من القيود على ممارسة هذا الحق إلا تلك التي تُفرض طبقاً للقانون وتشكل تدابير ضرورية، في مجتمع ديمقراطي، لصيانة الأمن القومي أو السلامة العامة أو النظام العام أو حماية الصحة العامة أو الآداب العامة أو حماية حقوق الآخرين وحرياتهم " .

Therefore it is worth recalling that international human rights law permits restrictions only if they " are necessary in a democratic society in the interests of national security or public safety, public order, the protection of public health or morals, or the protection of the rights and freedoms of others " .
والجدير بالذكر في هذا المقام أن القانون الدولي لحقوق الإنسان لا يسمح بفرض قيود إلا إذا كانت " ضرورية، في مجتمع ديمقراطي، لصيانة الأمن القومي أو السلامة العامة أو النظام العام أو حماية الصحة العامة أو الآداب العامة أو حماية حقوق الآخرين وحرياتهم " ().

35. The Committee emphasizes that the right of trade unions to function freely shall be subject to no restrictions " other than those prescribed by law and which are necessary in a democratic society in the interests of national security or public order or for the protection of the rights and freedoms of others " .
35- وتشدد اللجنة على أن حق النقابات في أن تعمل بحرية لا يخضع لأية قيود غير " تلك التي ينص عليها القانون وتشكل تدابير ضرورية، في مجتمع ديمقراطي، لصيانة الأمن القومي أو النظام العام أو لحماية حقوق الآخرين وحرياتهم " .
