The accused can be legally represented (this is compulsory as noted above, if he risks the death penalty or a sentence exceeding 15 years).

Although under customary law the right to life did not necessarily imply prohibition of the death penalty or of executions, on the basis of case law it could be said that States that had abolished the death penalty had an obligation not to expel a person sentenced to death to a State in which that person might be executed without first obtaining a guarantee that the death penalty would not be carried out.

Pursuant to the Code of Criminal Procedure, it is also prohibited to extradite a person to a foreign country if reasonable grounds exist to expect that in the country requesting extradition the person could be sentenced to the death penalty or the death sentence could be meted out, or that the person may be subjected to torture.

The Secretary-General regrets, however, that the new law fails to fully abolish the death penalty or to restrict its imposition to only the " most serious crimes " , as stipulated in article 6 (2) of the International Covenant on Civil and Political Rights.

وعملا بالمادة 31 (1) من قانون الأجانب لا يجوز إعادة أجنبي إلى بلده إذا ما كان سيتعرض لعقوبة الإعدام أو للتعذيب أو لمعاملة أو عقوبة لا إنسانية أو مهينة، أو حيث لا يكون الأجنبي في مأمن من إرساله إلى ذلك البلد ( " عدم الإعادة القسرية " ).

In the light of the fact that the Covenant is applied in HKSAR subject to a reservation that seriously affects the application of article 13 in relation to decisionmaking procedures in deportation cases, the Committee remains concerned that persons facing a risk of imposition of the death penalty or of torture, or inhuman, cruel or degrading treatment as a consequence of their deportation from HKSAR may not enjoy effective protection.
245- ونظرا إلى أن العهد يطبق في منطقة هونغ كونغ الإدارية الخاصة رهنا بتحفظ يؤثر بشكل خطير على تطبيق المادة 13 المتعلقة بإجراءات اتخاذ القرارات في حالات الإبعاد، فإن اللجنة يساورها القلق لأن الأشخاص الذين يواجهون خطر التعرض لعقوبة الإعدام أو للتعذيب أو للمعاملة اللاإنسانية أو القاسية أو المهينة نتيجة إبعادهم عن منطقة هونغ كونغ الإدارية الخاصة ربما لن يتمتعوا بحماية فعالة.

Article 2 of the Charter states that " no one shall be condemned to the death penalty, or executed " , and article 19 states that " no one may be removed, expelled or extradited to a State where there is a serious risk that he or she would be subjected to the death penalty, torture or other inhumane or degrading treatment or punishment " .
وتنص المادة 2 من الميثاق على أنه لن يدان أي شخص بعقوبة الإعدام أو تُنفذ فيه حكم الإعدام. وتنص المادة 19 على أنه " لا يجوز نقل أي شخص أو طرده أو تسليمه إلى دولة يواجه فيها خطراً حقيقياً يعرضه لعقوبة الإعدام أو التعذيب أو غير ذلك من ضروب المعاملة اللاإنسانية أو المهينة أو العقاب " .
