As the Court rightly sees it, the answer to the question asked of it by the General Assembly does not lie alone in a finding that the threat or use of nuclear weapons would be contrary to the rules of international law applicable in armed conflict, and in particular the principles and rules of humanitarian law.
٣ - وكما ترى المحكمة بحق أن اﻹجابة عن السؤال الذي وجهته إليها الجمعية العامة لا تكمن فقط في الحكم بأن التهديد باﻷسلحة النووية أو استخدامها مخالف لقواعد القانون الدولي المنطبقة في النزاع المسلح، وخاصة مبادئ القانون اﻹنساني وقواعده.

The first paragraph of Point 2.E does not explain what is to be understood by " generally ... contrary to the rules of international law applicable in armed conflict " (emphasis added), and the wording of the second paragraph of Point 2.E avoids to take a position when it says that,
فالفقرة اﻷولى من النقطة ٢ - هاء لا تشرح ما ينبغي أن يفهم من عبارة " مخالف بصورة عامة لقواعد القانون الدولي المنطبقة في أوقات النزاع المسلح. " )التوكيد مضاف( وصياغة الفقرة الثانية من النقطة ٢ - هاء تتجنب اتخاذ أي موقف حين تقول أنه:

25. I do not consider it juridically meaningful to say that the use of nuclear weapons is " generally contrary to the rules of international law applicable in armed conflict, and in particular the principles and rules of humanitarian law " .
٢٥ - ولا أعتبر أن هناك أي جدوى قضائية في القول بأن استخدام اﻷسلحة النووية يكون " بصورة عامة مخالفا لقواعد القانون الدولي المنطبقة في أوقات النزاع المسلح، وخاصة مبادئ القانون اﻹنساني وقواعده " .

" Reaffirming the need to continue the codification and progressive development of the rules of international law applicable in armed conflict, "
:: " وإذ تؤكد من جديد أن من الضروري مواصلة التدوين والتطوير التدريجي لقواعد القانون الدولي المنطبقة في النـزاعات المسلحة " ،

Subject to a reservation about the use of the word " generally " , I agree with the Court " that the threat or use of nuclear weapons would generally be contrary to the rules of international law applicable in armed conflict, and in particular the principles and rules of humanitarian law " .
وأنا، مع مراعاة تحفﱡظي على استخدام عبارة " بصورة عامة " أتﱠفق مع المحكمة في أن " التهديد باﻷسلحة النووية أو استخدامها يكون بصورة عامة مخالفا لقواعد القانون الدولي المنطبقة في أوقات النزاع المسلح، وخاصة مبادئ القانون اﻹنساني وقواعده " .

Inferentially, it is because recourse to nuclear weapons could not meet the aforementioned requirements that the Court has found " that the threat or use of nuclear weapons would generally be contrary to the rules of international law applicable in armed conflict, and in particular the principles and the rules of humanitarian law " .
ولما كان اللجوء إلى اﻷسلحة النووية لايمكن أن يتفق مع الشروط المشار إليها أعلاه، يمكن للمرء أن يستنتج أن ذلك هو السبب الذي جعل المحكمة تقرر أن " التهديد باﻷسلحة النووية أو استخدامها يكون بصورة عامة مخالفا لقواعد القانون الدولي المنطبقة في أوقات النزاع المسلح، وخاصة مباديء القانون اﻹنساني وقواعده " .

Indeed, the landmark advisory decision of the International Court of Justice (ICJ) of 8 July 1996 provided that " the threat or use of nuclear weapons would generally be contrary to the rules of international law applicable in armed conflict, and in particular the principles and rules of humanitarian law " .
وبالفعل نصت الفتوى المرجعية الصادرة عن محكمة العدل الدولية في 8 تموز/يوليه 1996 على أن " التهديد باستخدام الأسلحة النووية أو استخدامها يعد منافياً بوجه عام لقواعد القانون الدولي المنطبقة في أوقات النزاع المسلح وخاصة مبادئ القانون الإنساني وقواعده " .

6. Paragraph 2E states in its first part that the threat or use of nuclear weapons would generally be contrary to the rules of international law applicable in armed conflict, in particular the principles and rules of humanitarian law; and in its second part that the Court cannot conclude whether a threat or use of nuclear weapons in extremis in self-defence, where a State's very survival was at stake, would be lawful or unlawful.
٦ - وتشير الفقرة ٢ هاء في جزئها اﻷول إلى أن التهديد باﻷسلحة النووية أو استخدامها مخالف عموما لقواعد القانون الدولي المنطبقة في حالات النزاع المسلح، لا سيما مبادئ وقواعد القانون اﻹنساني؛ ولم تستطع المحكمة، في الجزء الثاني، أن تقرر إن كان من المشروع التهديد باﻷسلحة النووية أو استخدامها في الظروف القصوى في سياق الدفاع عن النفس، عندما يكون بقاء الدولة ذاته معرضا للخطر.
