As well, the proposal acknowledged the reality that, in certain circumstances, a party might choose not to present its case, and for that reason it would be more appropriate to refer to that party being given an opportunity to present its case.
وأفيد أيضا بأن الاقتراح يسلِّم بالحقيقة التي مفادها أن الطرف قد يختار في بعض الظروف عدم عرض قضيته، ولتلك الأسباب قد يكون من الأنسب الإشارة إلى إتاحة فرصة لذلك الطرف لكي يعرض قضيته.

بيد أنه يجوز لهيئة التحكيم أن تصدر تدبيرا مؤقتا يعتمد الأمر الأوّلي أو يُعدّلـه، بعد أن يكون قد تم توجيه إشعار إلى الطرف الذي يكون الأمر الأوّلي موجها ضده وتمت إتاحة الفرصة له لكي يعرض قضيته.

One proposal was that the time period for the responding party to present its case should be more flexible and refer simply to " the earliest possible time " .
فذهب أحد الاقتراحات إلى أن الفترة الزمنية المتاحة للمدّعى عليه لكي يعرض قضيته ينبغي أن تكون أكثر مرونة وأن يشار فحسب إلى " أقرب وقت ممكن " .

108. It was noted that paragraph 2 required the arbitral tribunal to give the party against whom a preliminary order was directed an opportunity to present its case at the earliest practicable time.
108- لوحظ أن الفقرة (2) تقتضي من هيئة التحكيم أن تمنح الطرف الذي يكون الأمر الأولي موجّها ضده فرصة لكي يعرض قضيته في أقرب وقت ممكن عمليا.

(2) At the same time, the arbitral tribunal shall give an opportunity to any party against whom a preliminary order is directed to present its case at the earliest practicable time.
(2) يتعين على هيئة التحكيم، في الوقت نفسه، أن تتيح الفرصة لأي طرف يكون مستهدفا بالأمر الأوّلي لكي يعرض قضيته في أقرب وقت ممكن عمليا.

Under that proposal, the party against whom the order was directed should be given an opportunity to present its case " at the earliest practicable time " and wording should be added along the lines of " the arbitral tribunal must decide as promptly as possible under the circumstances " .
وبمقتضى هذا الاقتراح، ينبغي أن تُتاح فرصة للطرف الذي يكون الأمر موجّها ضده لكي يعرض قضيته " في أقرب وقت ممكن عمليا " ، وينبغي إضافة عبارة على نسق الصيغة " يجب على هيئة التحكيم أن تقرّر في أسرع وقت ممكن بمقتضى الظروف الراهنة " .

50. After discussion, it was decided that subparagraph (e) should read along the following lines: " The arbitral tribunal shall give an opportunity to the party against whom the preliminary order is directed to present its case at the earliest practicable time.
50- وبعد المناقشة، تقرّر أن يُصاغ نص الفقرة الفرعية (ﻫ) على النحو التالي: " تتيح هيئة التحكيم فرصة للطرف الذي يكون الأمر الأوّلي موجّها ضده لكي يعرض قضيته في أقرب وقت ممكن عمليا.

(e) At the same time, the arbitral tribunal shall give an opportunity to any party against whom a preliminary order is directed to present its case at the earliest practicable time;
(ﻫ) يتعين على هيئة التحكيم، في الوقت نفسه، أن تتيح الفرصة لأي طرف يكون الأمر الأوّلي موجّها ضده لكي يعرض قضيته في أقرب وقت ممكن عمليا.

It was suggested that greater clarity could be brought as to when the notice should be given, by providing that the arbitral tribunal should give the opportunity to the party against whom the order was directed to present its case at the same time as the notification under subparagraph (d) occurred.
وذكر أنه يمكن تحقيق قدر أكبر من الوضوح يبيّـن متى ينبغي توجيه الإخطار، بالنصّ على أنه ينبغي لهيئة التحكيم أن تتيح الفرصة للطرف الذي يوجّه الأمر ضده لكي يعرض قضيته في الوقت نفسه الذي يقع فيه الإخطار بمقتضى الفقرة (د).

It was noted that while paragraph 1 required the arbitral tribunal to give notice to " all parties " , paragraph 2, which referred to " any party against whom a preliminary order is directed to present its case " , appeared to be more limited.
ولوحظ أن الفقرة (2)، التي تشير إلى إعطاء " أي طرف يكون الأمر الأولي موجّها ضده فرصة لكي يعرض قضيته " ، تبدو أضيق نطاقا من الفقرة (1) التي تقتضي من هيئة التحكيم أن تشعر " جميع الأطراف " .

(2) The party applying for a preliminary order shall disclose to the arbitral tribunal all circumstances that are likely to be relevant to the arbitral tribunal's determination whether to grant or maintain the order, and such obligation shall continue until the party against whom the order has been requested has had an opportunity to present its case.
(2) يتعيّن على الطرف الذي يطلب استصدار أمر أولي أن يكشف لهيئة التحكيم عن جميع الظروف التي يحتمل أن تكون ذات صلة باتخاذها قرارها فيما إذا كانت ستصدر الأمر أو تبقي عليه، ويتعين أن يستمر هذا الالتزام إلى أن تكون الفرصة قد أُتيحت للطرف الذي هو مستهدف بالأمر الذي قد طُلب استصداره لكي يعرض قضيته.
