37. The Committee noted that the nature and quality of the information provided by Member States requesting exemptions under Article 19 varied widely, with some providing little, if any, information to support their request.

The court held that the seller's enquiries to the registration office were no reason for an exemption under article 79 CISG and that the seller had failed to prove that " [it] could not reasonably be expected to have taken the impediment into account at the time of the conclusion of the contract or to have avoided or overcome it or its consequences " . Instead, several circumstances should have alerted the seller as to the origin of the car.
فقد رأت المحكمة أنَّ استعلام البائع في مكتب التسجيل ليس سببا للإعفاء بموجب المادة 79 من الاتفاقية وأنَّ البائع لم يثبت أنَّه " لم يكن من المتوقَّع بصورة معقولة أن يَأخُذ العائقَ في الاعتبار وقت انعقاد العقد أو أن يكون بإمكانه تجنُّبه أو تجنُّب عواقبه أو التغلُّب عليه أو على عواقبه " ، وإنما كان ينبغي للبائع أن ينتبه لمصدر السيارة نتيجة لظروف عديدة.
