54. The title selected during the debates for Part Two of the draft articles was correct from the legal viewpoint and faithfully reflected the contents of that Part.

The Commission might use the second reading of the draft to review the characteristics of exceptionally serious wrongful acts with regard not only to Part Two of the draft articles but also Part One, which, in actual fact, had been drafted with a unified regime approach.

(d) The present title of Part One should become the title of Part Two and start from article 3;

The present title of Part Two was not readily comprehensible or self-explanatory and could be replaced by the more straightforward phrase " Legal consequences of an internationally wrongful act of a State " , which conformed to the traditional view of State responsibility as a secondary legal consequence arising from a breach.
50- إن العنوان الحالي للباب الثاني لا يفهم بسهولة وغير واضح ويمكن الاستعاضة عنه بعبارة أبسط هي " النتائج القانونية لفعل الدولة غير المشروع دولياً " التي تتوافق مع وجهة النظر التقليدية التي تعتبر مسؤولية الدول نتيجة قانونية ثانوية للانتهاك.

In view of these considerations and also bearing in mind the indicative nature of Part II as provided for in article 19, the Czech Republic supports the text of article 23 in its current wording as a step in the right direction and a laudable attempt on the part of the Commission at the progressive development of international law.
وفي ضوء هذه الاعتبارات وكذلك مراعاة للطابع اﻹرشادي للباب الثاني على النحو المنصوص عليه في المادة ١٩، فإن الجمهورية التشيكية تؤيد نص المادة ٢٣ بصياغتها الحالية كخطوة في الاتجاه الصحيح ومحاولة جديرة بالثناء تقوم بها اللجنة في مجال التطوير التدريجي للقانون الدولي.

It was to be hoped that in its second reading of Part II of the draft Code the Commission would refine its definitions of crimes in order to approximate standards of criminal law as closely as possible.
١٤ - وأعرب عن أمله في أن تحسن اللجنة، لدى قراءتها الثانية للباب الثاني من مشروع المدونة، تعريفاتها للجرائم للاقتراب قدر اﻹمكان من معايير القانون الجنائي.
