يجوز حجب البيانات والمعلومات الحيوية للأمن القومي للدولة المصدر أو لحماية الأسرار الصناعية أو المتعلقة بالملكية الفكرية، ولكن يجب على الدولة المصدر أن تتعاون بحسن نية مع الدول الأخرى المعنية وأن تقدم ما يمكن تقديمه من المعلومات في هذه الظروف.

These negotiations mostly occur in cases where there is no agreement on the amount of the preventive measures and where the affected State contributes to the costs of preventive measures in order to ensure a higher degree of protection that it desires over and above what is essential for the State of origin to ensure.
وتجرى هذه المفاوضات، في معظم اﻷوقات، في الحالات التي لم يتم فيها الاتفاق على قدر التدابير الوقائية والتي تسهم فيها الدولة المتأثرة في تكاليف التدابير الوقائية بغية تأمين درجة أعلى من الحماية ترغب في تحقيقها علاوة عن الدرجة التي يكون تأمينها أساسيا بالنسبة للدولة المصدر.

(3) Article 15 recognizes the need for balance between the legitimate interests of the State of origin and the States that are likely to be affected.
)٣( وتعترف المادة ٥١ بضرورة إيجاد توازن بين المصالح المشروعة للدولة المصدر وللدول التي يحتمل أن تتأثر.

It was stressed that the object of the draft articles was to strike a balance between the sovereign right of the State of origin to use, develop and exploit its natural resources and its obligation to exercise that right in such a manner as not to cause significant harm to other States.

(10) Paragraph (d) on the other hand requires States affected or likely to be affected to extend to the State of origin their full cooperation.
