وإذا كان الزوج المكلّف بإدارة الأصول غائباً أو غير قادر على القيام بذلك، يجوز للزوج الآخر التصرّف في الملكية الزوجية بصورة استثنائية ومؤقتة كي يتم الاستفادة من تلك الأصول لتغطية احتياجات الأسرة.

In such a case, if the act is necessary in the interests of the family, then the other spouse can apply to the competent court for authorisation to perform the required act.
وفي هذه الحالة، إذا كان الإجراء لازما لمصلحة الأسرة، أمكن للزوج الآخر أن يتقدم بطلب للمحكمة المختصة لكي تصرح له بأداء الإجراء المطلوب.

If, notwithstanding the above conditions, one of the spouses transfers the matrimonial home without the required consent, the transfer maybe annulled by the other spouse within one year from the registration of the transfer.
