With regard to the protection and defence of the human rights of indigenous peoples and communities, it is worth pointing out that the Constitutional Division of the Supreme Court of Justice, in repeated rulings, has defined the competence of the Office of the Ombudsman to initiate amparo proceedings in respect of the common or collective interests of indigenous peoples and communities.

However, as the Supreme Court of Justice made clear, it is not authorized to initiate legal action or appeals aimed at protecting the direct or individual rights and interests of indigenous persons.
