The availability of multiple procurement methods allows States to tailor the procurement procedures according to the subject matter of the procurement and the needs of the procuring entity.

Allied to this issue, the wording in paragraph 5 referring to the notion in article 48 on the feasibility of formulating a detailed description of the subject matter of the procurement was queried.
99- وفيما يتصل بهذه المسألة، أثير تساؤل حول الصيغة الواردة في الفقرة 5 التي تشير إلى الفكرة الواردة في المادة 48 بشأن إمكان صوغ وصف تفصيلي للشيء موضوع الاشتراء.

The article has also been substantially revised. 2011 paragraph (1) is a new provision, and requires a description of the subject matter of the procurement in the solicitation and, where and as applicable, pre-qualification or pre-selection documents.
فالفقرة (1) من نص عام 2011 تتضمن حكماً جديداً وهي تتطلب وصفاً للشيء موضوع الاشتراء في وثائق الالتماس وكذلك، حسب مقتضى الحال، في وثائق التأهيل والاختيار الأوليين.

وإذا لم يكن من المجدي أو من الملائم وضع وصف كامل (يشمل المواصفات الفنية) للشيء موضوع الاشتراء منذ بداية إجراءات الاشتراء فقد يكون من الملائم استخدام طريقة المناقصة على مرحلتين أو طريقة طلب اقتراحات.

(ii) deleting or modifying any criterion for examining or evaluating tenders initially provided, and adding any new criterion that conforms to the requirements of this Law, to the extent only that the deletion or modification is required as a result of changes made in the technical or quality characteristics of the subject matter of the procurement; " .
`2` حذف أو تعديل أيِّ معيار لفحص العطاءات أو تقييمها منصوص عليه في البدء، وإضافة أيِّ معيار جديد يتوافق مع مقتضيات هذا القانون، على أن يقتصر ذلك على الحالات التي يكون فيها ذلك الحذف أو التعديل لازما بسبب ما أُدخل من تغييرات على الخصائص التقنية أو النوعية للشيء موضوع الاشتراء " .

With reference to paragraph (5), the point was made that the Guide should encourage the procuring entity not to draft its description of the subject matter of the procurement in a way that artificially limited the market concerned to a single source, and the experience in one jurisdiction in using functional descriptions to support this approach was shared.
89- وفيما يتعلق بالفقرة 5، رئي أنه ينبغي للدليل أن يشجّع الجهة المشترية على ألا تصوغ وصفها للشيء موضوع الاشتراء على نحو يجعل السوق المعنية، بصورة مفتعلة، محصورة في مصدر واحد، وعُرضت في هذا الصدد تجربة إحدى الولايات القضائية في استخدام أوصاف وظيفية دعما لهذا النهج.

The Commission agreed to delete the words " and precise " from the paragraph, as article 10 as amended at the current session (see para. 36 above) referred only to a " detailed " and not to a " precise " description of the subject matter of the procurement.
88- اتَّفقت اللجنةُ على حذف كلمة " ودقيقا " من الفقرة، لأنَّ المادة 10، بصيغتها المعدّلة في الدورة الحالية، (انظر الفقرة 37 أعلاه) لا تشير إلاَّ إلى وصف " مفصَّل " ولا تشير إلى وصف " دقيق " للشيء موضوع الاشتراء.

(a) It is not feasible for the procuring entity to formulate a detailed description of the subject matter of the procurement in accordance with article 10 of this Law, and the procuring entity assesses that dialogue with suppliers or contractors is needed to obtain the most satisfactory solution to its procurement needs;
