Appropriate containers and controlled environments, where necessary, should be used by a High Contracting Party when transporting munitions.

In order to minimise the failure rate due to incorrect use, a High Contracting Party should adopt an extensive training program in order to ensure that munitions are used correctly.
10- بغية التقليل من معدل الإخفاق الناجم عن الاستخدام غير الصحيح، ينبغي للطرف المتعاقد السامي أن يعتمد برنامجاً تدريبياً مكثفاً من أجل ضمان استخدام الذخائر استخداماً صحيحاً.

It shall subsequently be extended automatically for further five-year periods unless one of the High Contracting Parties notifies the other High Contracting Party in writing of its desire to terminate it at least six months before the expiry of the current period of validity.
ويُمدد مفعولها تلقائيا لفترات السنوات الخمس التالية، إذا لم يعلن أي من الطرفين المتعاقدين الساميين عن رغبته في إلغائها عن طريق إخطار كتابي للطرف المتعاقد السامي الثاني في وقت سابق على انتهاء مدة السريان بفترة ستة أشهر على اﻷقل.

2. A High Contracting Party may defer compliance with the prohibition of transfer for a period not exceeding 5 years from the entry into force of this Protocol.
2- يجوز للطرف المتعاقد السامي تأجيل الامتثال لأحكام حظر النقل وذلك لفترة لا تتجاوز 5 سنوات من بدء نفاذ هذا البروتوكول.

A High Contracting Party should establish a munition stockpile reliability programme, which includes periodic testing of the inventory.
4- ينبغي للطرف المتعاقد السامي أن ينشئ برنامجاً لضمان موثوقية المخزونات من الذخائر يشتمل على إجراء اختبارات دورية للمخزون.

A High Contracting Party should transport munitions to and from production facilities, storage facilities and the field in a manner that minimises damage to the munitions.

“If the Court finds that there has been a violation of the Convention or the protocols thereto, and if the internal law of the High Contracting Party concerned allows only partial reparation to be made, the Court shall, if necessary, afford just satisfaction to the injured party.”

A High Contracting Party should establish munition logging and tracking procedures, which should include information on the date of manufacture of each munition or batch of munitions, expected shelf-life of each munition or batch of munitions, and information on where the munition has been, under what conditions it has been stored and to what environmental factors it has been exposed.
8- ينبغي للطرف المتعاقد السامي أن يضع إجراءات لتسجيل وتعقب الذخائر تشتمل على معلومات عن تاريخ صنع كل ذخيرة أو مجموعة من الذخائر، والعمر المتوقع لكل ذخيرة أو مجموعة من الذخائر، ومعلومات عن المكان الذي كانت توجد فيه الذخيرة، وأحوال تخزينها، والعوامل البيئية التي تعرضت لها.

A High Contracting Party planning to transfer munition to another State that did not previously possess that type of munition should endeavour to ensure that the receiving State has the capability to correctly store, maintain and use that munition.
11- ينبغي للطرف المتعاقد السامي الذي يعتزم أن ينقل ذخائر إلى دولة أخرى لم تكن في السابق تمتلك ذلك النوع من الذخائر، أن يسعى إلى ضمان أن تكون لدى الدولة المتلقية القدرة على تخزين تلك الذخائر وصيانتها واستخدامها على نحو صحيح.

5. Nothing in this Protocol shall be invoked as a justification for intervening, directly or indirectly, for any reason whatever, in the armed conflict or in the internal or external affairs of the High Contracting Party in the territory of which that conflict occurs.
5- لا يجوز الاستناد إلى أي شيء في هذا البروتوكول كمبرر للتدخل، بصورة مباشرة أو غير مباشرة، لأي سبب كان، في النزاع المسلح أو في الشؤون الداخلية أو الخارجية للطرف المتعاقد السامي الذي يحدث ذلك النزاع في إقليمه.

Recipient: The information should be released to the affected High Contracting Party and to those persons or institutions for which the releasing High Contracting Party is satisfied that they are, or will be, involved in UXO clearance in the affected areas.
(ب) المتلقي: ينبغي أن تتاح المعلومات للطرف المتعاقد السامي المتأثر وللأشخاص أو المؤسسات التي يكون الطرف السامي المتعاقد الذي يتيح المعلومات مقتنعاً بأنها تشارك، أو سوف تشارك، في عمليات إزالة الذخائر غير المتفجرة من المناطق المتأثرة.

Recipient: The information should be released to the affected High Contracting Party and to those persons or institutions for which the releasing High Contracting Party is satisfied that they are, or will be, involved in the clearance of the affected area.

According to article 41 of the European Convention on Human Rights, " If the Court finds that there has been a violation of the Convention or the protocols thereto, and if the internal law of the High Contracting Party concerned allows only partial reparation to be made, the Court shall, if necessary, afford just satisfaction to the injured party. "

In that case, the Commission believed that it followed from the " clear wording " of article 57 (former article 64), paragraph 1, of the European Convention on Human Rights " that a High Contracting Party may not, in subsequent recognition of the individual right of appeal, make a major change in its obligations arising from the Convention for the purposes of procedures under article 25 " .
