15. In the light of the above, the Working Group considers that the case also shows the arbitrary nature of the detention according to category III of its methods of work.

18. Furthermore, there are no allegations of clear infringements of due process of law, such as, for instance, refusal to admit evidence provided by the accused, or other serious violations making the detention arbitrary according to Category III of the criteria used in considering cases submitted to the Working Group

The Working Group further determines that Mr. Gam's arrest and detention is also considered arbitrary pursuant to Category III of the categories defined by the Working Group, as it is in breach of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment as enshrined in General Assembly resolution 43/173 of 9 December 1988.

The 2003 Group of Governmental Experts, however, reached agreement on technical adjustments to Category III of the Register by lowering the reporting threshold for large-calibre artillery systems from 100 mm to 75 mm and by including MANPADS as a subcategory in category VII. The Group also agreed to allow for additional voluntary background information on the transfer of small arms and light weapons.

(a) The deprivation of liberty of Mr. Israel Arzate Meléndez violates the human rights protected under articles 3, 7, 8, 9, 10 and 11 of the Universal Declaration of Human Rights and article 2, paragraph 3, and articles 3, 7, 9, 10 and 14 of the International Covenant on Civil and Political Rights, and is therefore arbitrary according to Category III of the Working Group's methods of work;
