The Court held that, pursuant to article 4 CISG, the Convention is not concerned with issues of representation. The matter was thus to be settled in conformity with the law applicable by virtue of the rules of private international law.
وذكرت المحكمة العليا أنه وفقا للمادة 4 من اتفاقية البيع، لا تتناول الاتفاقية مسائل التمثيل، ومن ثم ينبغي البت في هذه القضية وفقا للقانون المنطبق بمقتضى قواعد القانون الدولي الخاص.

However, if a matter is considered to fall outside the Convention's scope, it must be settled in conformity with the law applicable by virtue of the rules of private international law, without any recourse to the " general principles " of the Convention.
بيد انه إذا اعتبرت مسألة ما خارجة عن نطاق الاتفاقية، فإنه يجب تسويتها طبقاً للقانون المنطبق بمقتضى قواعد القانون الدولي الخاص، دون أي رجوع إلى " المبادئ العامة " للاتفاقية.

The Court thus referred to CISG article 7, which states that questions concerning matters governed by the Convention, which are not expressly settled in it should be settled in conformity with the general principles on which the Convention is based or, in their absence, in conformity with the law applicable by virtue of international private law rules.
ومن ثم، أشارت المحكمة إلى المادة 7 من اتفاقية البيع، التي تنص على أن المسائل المتعلقة بأمور لا تحكمها الاتفاقية، ولا تسوَّى فيها صراحةً، ينبغي أن تسوَّى وفقاً للمبادئ العامة التي تقوم عليها الاتفاقية، أو، في حال انتفائها، وفقاً للقانون المنطبق بمقتضى قواعد القانون الدولي الخاص.

As the CISG does not deal with the limitation period, this question was governed by the law applicable under the German rules of private international law, according to which the action was not time-barred.
وبما أن اتفاقية البيع لا تعالج فترة التقادم، فان هذه المسألة تخضع للقانون المنطبق بمقتضى قواعد القانون الدولي الخاص الألماني الـذي لا تسقـط الدعوى بالتقـادم وفقا له.

There is no comment to article 18 pointing out the difference with the location rule in the United Nations Assignment Convention (referring to the place of the assignor's central administration), as a result of which the law applicable under the proposed regulation article 13 (3) may be different from the law applicable under article 22 of the United Nations Assignment Convention.
ولا يوجد تعليق على المادة 18 يشير إلى التباين مع قاعدة المقر في اتفاقية الأمم المتحدة بشأن المستحقات (التي تشير إلى مكان الإدارة المركزية للمحيل)، ومن ثم فإن القانون المنطبق بمقتضى المادة 13 (3) من اللائحة التنظيمية المقترحة قد يكون مغايرا للقانون المنطبق بمقتضى المادة 22 من اتفاقية الأمم المتحدة بشأن المستحقات.
