The Supreme Court held that, according to article V of the European Convention on International Commercial Arbitration of 1961, jurisdictional objections on the alleged non-existence or non-applicability of arbitration agreements must be raised prior to pleadings on the merits of the dispute.
ورأت المحكمة العليا، وفقا للمادة الخامسة من الاتفاقية الأوروبية للتحكيم التجاري الدولي لعام 1961، أنَّ الاعتراضات على الاختصاص القضائي المستندة إلى زعم عدم وجود اتفاقات تحكيم أو عدم انطباقها يجب أن تثار قبل المرافعات المتعلقة بجوهر النزاع.

(c) Consider options for addressing doubts and ambiguities in accordance with article V of the Convention.
