ويترك هذا الإجراء أحد التساؤلات دون إجابة وهو إذا لم تعد الشركة قائمة في مكان تأسيسها نتيجة للضرر الناجم من فعل غير مشروع دوليا ارتكبته دولة أخرى فهل يجب رفع الدعوى ضد الدولة المسببة للضرر بواسطة دولة الجنسية لحملة الأسهم وفقا للمادة المقترحة 18 (أ) أم يجب أن ترفعها دولة الجنسية للشركة الميتة.
