If the guarantor/issuer, confirmer or nominated person acknowledges a secured creditor or transferee of the proceeds under an independent undertaking, the secured creditor or transferee may enforce its rights against the person that made the acknowledgement, since the independence of the undertaking is not compromised (see A/CN.9/631, recommendation 126).
وإذا اعترف الكفيل/المصدر أو المثبت أو الشخص المسمّى بدائن مضمون أو بشخص تُحال إليه العائدات بمقتضى تعهّد مستقل، جاز للدائن المضمون أو للمحال إليه أن يُنفِِذ حقوقه تجاه الشخص الذي قام بالاعتراف، نظرا إلى أن استقلالية التعهّد لم تمسّ (انظر التوصية 126 في الوثيقة A/CN.9/631).
