The workload of the Division has increased as a result of a 41 per cent increase in the number of cases appealed to the Administrative Tribunal, which led to additional work in providing advice to relevant Secretariat units regarding the implementation of such judgements.

1. Article 3, paragraphs 1 and 2, of the statute of the United Nations Administrative Tribunal (General Assembly resolution 351 A (IV) of 24 November 1949) provides as follows:
١ - تنص الفقرتان ١ و ٢ من المادة ٣ من النظام اﻷساسي للمحكمة الادارية لﻷمم المتحدة )قرار الجمعية العامة ٣٥١ ألف )د - ٤( المؤرخ ٢٤ تشرين الثاني/نوفمبر ١٩٤٩( على ما يلي:

1. The item entitled " Review of the procedure provided for under article 11 of the statute of the Administrative Tribunal of the United Nations " was included in the provisional agenda of the forty-ninth session of the General Assembly pursuant to Assembly decision 48/415 of 9 December 1993.
١ - أدرج البند المعنون " استعراض الاجراء المنصوص عليه في المادة ١١ من النظام اﻷساسي للمحكمة الادارية لﻷمم المتحدة " في جدول اﻷعمال المؤقت للدورة التاسعة واﻷربعين للجمعية العامة عملا بمقرر الجمعية العامة ٤٨/٤١٥ المؤرخ ٩ كانون اﻷول/ديسمبر ١٩٩٣.

(b) To include in the provisional agenda of its fiftieth session the item entitled " Review of the procedure provided for under article 11 of the statute of the Administrative Tribunal of the United Nations " .

8. The Committee decided, without a vote, that there was not a substantial basis for the application under article 11 of the statute of the Administrative Tribunal and therefore concluded that the International Court of Justice should not be requested to give an advisory opinion in respect of Judgement No. 622 delivered by the United Nations Administrative Tribunal in the case of Araim against the Secretary-General of the United Nations.
٨ - وقررت اللجنة، دون تصويت، عدم وجود أساس جوهري للطلب بموجب المادة ١١ من النظام اﻷساسي للمحكمة الادارية ولذلك خلصت الى أنه ينبغي ألا يطلب الى محكمة العدل الدولية إصدار فتوى بصدد الحكم رقم ٦٢٢ الصادر عن المحكمة الادارية لﻷمم المتحدة في قضية عريم ضد اﻷمين العام لﻷمم المتحدة.

12. The Committee decided, without a vote, that there was not a substantial basis for the application under article 11 of the statute of the Administrative Tribunal and therefore concluded that the International Court of Justice should not be requested to give an advisory opinion in respect of Judgement No. 630 delivered by the United Nations Administrative Tribunal in the case of Kofi against the Secretary-General of the United Nations.
١٢ - وقررت اللجنة، دون تصويت، عدم وجود أساس جوهري للطلب بموجب المادة ١١ من النظام اﻷساسي للمحكمة الادارية ولذلك فقد خلصت الى أنه ينبغي ألا يطلب الى محكمة العدل الدولية أن تصدر فتوى بصدد الحكم رقم ٦٣٠ الصادر عن المحكمة الادارية لﻷمم المتحدة في قضية كوفي ضد اﻷمين العام لﻷمم المتحدة.

10. The United Nations suggested to CCAQ that article 13 (2), quoted above, could be amended along the same lines as suggested above for article 20 (1) of the Rules of the United Nations Administrative Tribunal.
