In the light of the evolving situation in Kosovo, on the basis of extensive consultations with Belgrade, Pristina and key stakeholders and pending guidance from the Security Council, it is my intention to adjust operational aspects of the international civil presence in Kosovo.

When the Security Council authorized the SecretaryGeneral to establish an international civil presence in Kosovo in order to provide an interim administration for Kosovo, under which the people of Kosovo can enjoy substantial autonomy within the Federal Republic of Yugoslavia (operative para. 10), it decided that the main responsibilities of this international civil presence would include:

As described above (see paragraph 60), on 12 June 1999, the Secretary-General presented to the Security Council his preliminary operational concept for the overall organization of the civil presence under UNMIK.

20. It is my intention to consult further with relevant partners, including the European Union and OSCE, with a view to determining the functional provisions for the continued international civil presence and moving forward with the implementation of those provisions as soon as feasible.

In that connection, I am grateful for the continuing commitment of the North Atlantic Treaty Organization to support the international civil presence in accordance with resolution 1244 (1999).

The Committee notes that, in accordance with Security Council resolution 1244 (1999), Kosovo currently remains a part of Serbia and Montenegro as successor State to the Federal Republic of Yugoslavia, albeit under interim international administration, and the protection and promotion of human rights is one of the main responsibilities of the international civil presence (paragraph 11 (j) of the resolution).

59. In paragraph 11 (k) of Security Council resolution 1244 (1999), the Council states that the main responsibilities of the international civil presence will include " assuring the safe and unimpeded return of all refugees and displaced persons to their homes in Kosovo " .

The text of the resolution explains that the " main responsibilities of the international civil presence will include ... [o]rganizing and overseeing the development of provisional institutions for democratic and autonomous self-government pending a political settlement " (para. 11 (c) of the resolution; emphasis added).

Resolution 1244 (1999) further states that " the main responsibilities of the international civil presence will include ... In that report, I also informed the Security Council that, in the light of recent developments in Kosovo, I intended to adjust operational aspects of the international civil presence and reconfigure UNMIK in order to allow for the European Union to take on an increasing role in the rule of law sector, operating under resolution 1244 (1999) and under a " United Nations umbrella " , headed by my Special Representative.

They noted the ongoing process of streamlining the civilian presence in Bosnia under the auspices of the Peace Implementation Conference and in that regard the proposal of the Special Representative of the Secretary-General in Bosnia and Herzegovina, Jacques Paul Klein, to " recalibrate " the current structure of the civilian presence on the ground.
