I have been entrusted with the task of conveying to you the following response:

That meeting produced a statement containing a decision by the Council to issue an invitation to the Special Commission, with its full complement of members, to return to Iraq to pursue its work there.
أود إبلاغكم بأن السيد الرئيس صدام حسين رئيس جمهورية العراق رأس اجتماعا لمجلس قيادة الثورة صباح يوم الخميس، ٢٠ تشرين الثاني/نوفمبر ١٩٩٧ وصدر عن الاجتماع بيان تضمن قرارا بتوجيه الدعوة إلى اللجنة الخاصة بكامل أعضائها للعودة إلى العراق لممارسة عملها فيه.

The decree, signed by Saddam Hussein as Chairman of the Revolution Command Council, stipulates that anyone liable to compulsory military service shall be released from service following completion of the 90-day basic training and payment of " an exemption tax of 1 million dinars in cash " .
وينص المرسوم، الذي وقعه صدام حسين بوصفه رئيسا لمجلس قيادة الثورة، على أن يتم تسريح أي شخص خاضع للخدمة العسكرية اﻹلزامية من الخدمة عقب إتمام فترة التدريب اﻷساسي التي تبلغ ٩٠ يوما إذا دفع " بدلا نقديا قدره نصف مليون دينار " تزاد إلى مليون دينار للمكلف بخدمة الاحتياط.

This statement was broadcast by Radio Baghdad on Thursday, 6 October 1994, at 2.30 p.m.
بناء على تعليمات من حكومتي، أود أن أوجه انتباهكم للبيان الذي أدلى به ناطق رسمي في ختام الاجتماع المشترك لمجلس قيادة الثورة وقيادة حزب البعث برئاسة صدام حسين، والذي أذاعته إذاعة بغداد ظهر هذا اليوم، الخميس الموافق ٦ تشرين اﻷول/أكتوبر ١٩٩٤، في تمام الساعة ٣٠/١٤.

Issued on 1 September 1969, the first communiqué of the Revolution Command Council comprised the Proclamation of Revolution, which decreed that the Libyan Arab Jamahiriya was to pursue the path of social justice and guarantee the right of equality for its sons and daughters, who would be neither oppressed nor wronged, neither master nor servant, but free brothers.
وقد صدر البيان الأول لمجلس قيادة الثورة في الأول من شهر أيلول/سبتمبر 1969 متضمناًَ إعلان قيام الثورة الذي نص على أن ليبيا سائرة في طريق العدالة الاجتماعية، كافلة لأبنائها حق المساواة فلا مهضوم ولا مغبون ولا مظلوم ولا سيد ولا مسود، بل أخوة أحرار.

Beginning with his first report, Van der Stoel has deliberately repeated the same allegations with regard to the structure of power in Iraq, claiming that the Revolution Command Council has wide-ranging jurisdiction, and that enormous power is concentrated in extremely few hands, with ultimate power vested in the person of the President of the Republic.

17. Paragraph 23 of the report refers to the fact that Revolution Command Council Decree No. 840 of 4 November 1986, promulgated at the height of the Iraq—Iran war, prohibited the publication of anything derogatory to the armed forces in wartime or to the head of State, who is its national symbol, in order to safeguard national unity.
٧١- ورد في الفقرة )٣٢( من التقرير إشارة إلى قرار لمجلس قيادة الثورة رقم ٠٤٨ الصادر في ٤/١١/٦٨٩١، وهو قرار صدر عام ٦٨٩١ خلال اشتداد الحرب العراقية اﻹيرانية، يتضمن عدم المس بالقوات المسلحة زمن الحرب وكذلك عدم المس برأس الدولة كونه رمزها الوطني، وقد قصد منه الحفاظ على الوحدة الوطنية.

Concerning the legislative power, the Human Rights Committee referred expressly to “article 42 of the Constitution [which] gives power to the Revolution Command Council to issue laws, decrees and decisions without being subject to independent scrutiny or review to ensure their compliance with the provisions of the Covenant” (ibid., para. 19).
٠٣- وفيما يخص السلطة التشريعية، اشارت اللجنة المعنية بحقوق اﻹنسان صراحة إلى " المادة ٢٤ من الدستور ]التي[ تعطي لمجلس قيادة الثورة سلطة إصدار قوانين ومراسيم ومقررات بدون اخضاعها لفحص أو استعراض مستقلين لتأمين تمشيها مع أحكام العهد " . )المرجع السابق، الفقرة ٩١(.

In addition to the specific decrees mentioned above, the Special Rapporteur further observes that virtually all such decrees have been adopted pursuant to article 42 (a) of the Provisional Constitution of Iraq, which the Special Rapporteur has previously criticized as granting virtually dictatorial power to the Revolution Command Council and, in fact, the President (see E/CN.4/1994/58, paras. 164, 168-170 and 176).

The meeting was held further to the review by the Security Council on 27 April 1998 of the sanctions regime against Iraq.

13. On 6 October 1994, a joint meeting of Iraq's Revolution Command Council and the Iraqi Command of the Ba'ath Party indicated that, unless the Security Council's consideration of the Commission's biannual report on the implementation of ongoing monitoring and verification (S/1994/1138 and Corr.1) to take place on or about 10 October 1994 were favourable to Iraq, Iraq might withdraw its cooperation with the Commission.
١٣ - وفي ٦ تشرين اﻷول/اكتوبر ١٩٩٤، أعلن اجتماع مشترك لمجلس قيادة الثورة العراقي وللقيادة القطرية لحزب البعث في العراق أن نظر مجلس اﻷمن في التقرير نصف السنوي الذي تقدمه اللجنة بشأن تنفيذ الرصد والتحقق المستمرين )S/1994/1138 و Corr.1(، المقرر عقده في ١٠ تشرين اﻷول/اكتوبر ١٩٩٤ أو في تاريخ قريب من ذلك التاريخ، إذا لم يسفر عن نتيجة في صالح العراق، فإن العراق قد يتراجع عن التعاون مع اللجنة.
