4.4 With regard to the author's remaining complaints, the State party submits copies of the relevant documents and argues that:
٤-٤ وتقــدم الدولــة الطرف فيما يتعلق بالشكاوى المتبقية لمقدم البلاغ نسخا من الوثائق ذات الصلة وتدفع بما يلي:

In the circumstances of the case, the Committee did not consider that a petition for amparo before the Constitutional Court was a remedy available to the author.
وإزاء الظروف التي أحاطت بالدعوى، رأت اللجنة أن طلب تدبير الحماية المؤقتة أمام المحكمة الدستورية لم يكن من سبل الانتصاف المتاحة لمقدم البلاغ.

The State party argues, however, that another remedy was available to the author under the federal Racial Discrimination Act 1975.
ومع ذلك تحاجي الدولة الطرف بأن ثمة سبيل انتصاف آخــر كــان متاحـا لمقدم البلاغ بموجب القانون الاتحادي ضد التمييز العنصري لعام ٥٧٩١.

Pursuant to section 25 of the Constitution, it is open to the author to seek redress for the alleged violations of his rights by way of a constitutional motion to the Supreme Court.
وعملا بالفرع ٢٥ من الدستور يحق لمقدم البلاغ أن يلتمس الانتصاف من الانتهاكات المزعومة لحقوقه، عن طريق طلب دستوري يقدم الى المحكمة العليا.

Counsel argues, however, that the State party has not made any effort to verify the author's current situation and determine whether he is safe and at risk of being subjected to torture.

In particular, the State party should indicate what remedy it has afforded the author of the communication whose rights the Committee found to have been violated.

Nevertheless, the ethnic origin of the author is no longer disputed by the State party.

Many of the replies received could be considered satisfactory in that they displayed the State party's willingness to implement the Committee's Views or to offer the applicant an appropriate remedy.
ويمكن اعتبار الكثير من الردود الواردة مرضية، لأنها تكشف عن استعداد الدولة الطرف لتنفيذ آراء اللجنة أو لإتاحة وسيلة انتصاف ملائمة لمقدم البلاغ.

In this respect, accordingly, the author has no claim within the meaning of article 2 of the Optional Protocol.

On 8 May 1987, the High Court of Australia refused the author leave to appeal.
وفي ٨ أيار/ مايو ٧٨٩١، رفضت المحكمة العليا لاستراليا أن تأذن لمقدم البلاغ بالطعن في الحكم.
