Model Law against Trafficking in Persons

The Model Law against Trafficking in Persons has been developed to assist States in implementing the provisions contained in the Protocol to Prevent, Suppress and Punish Trafficking in Persons, especially Women and Children, supplementing that Convention.
وُضع القانون النموذجي لمكافحة الاتِّجار بالأشخاص من أجل مساعدة الدول في تنفيذ الأحكام الواردة في بروتوكول منع وقمع ومعاقبة الاتِّجار بالأشخاص، وبخاصة النساء والأطفال، المكمِّل لاتفاقية الأمم المتحدة لمكافحة الجريمة المنظَّمة عبر الوطنية.

At the end of July 2013, in cooperation with the Ministry of Justice of Congo, UNODC organized a validation workshop with respect to the draft legislation to Combat Trafficking in Persons.

Consider the formulation of a national action plan or inter-agency mechanism to Combat Trafficking in Persons and provide assistance to victims, bearing in mind the need to integrate a human rights-based approach (Philippines);
49- أن تنظر في وضع خطة عمل وطنية أو في إنشاء آلية مشتركة بين الوكالات لمكافحة الاتِّجار بالأشخاص ومساعدة الضحايا، واضعة في اعتبارها الحاجة إلى الأخذ بنهج يقوم على أساس حقوق الإنسان (الفلبين)؛

(f) The establishment in November 2008 of the Interinstitutional Committee to Combat Trafficking in Persons, with the corresponding Comprehensive National Strategy for 20072012, and the Operations Centre to Combat Human Trafficking;
(و) إنشاء اللجنة المؤسسية المشتركة لمكافحة الاتِّجار بالأشخاص في عام 2008 ووضع الاستراتيجية الوطنية الشاملة للفترة 2007-2012 وإنشاء مركز عمليات مكافحة الاتِّجار؛

(f) The establishment in November 2008 of the Inter institutional Committee to Combat Trafficking in Persons, with the corresponding Comprehensive National Strategy for 2007 2012, and the Operations Centre to Combat Human Trafficking;

35- ويعتمد القانون النموذجي لمكافحة الاتِّجار بالأشخاص الذي أعدته وزارة الخارجية في الولايات المتحدة نهج بروتوكول الاتِّجار بالأشخاص مع إيضاح أنَّ " موضوع الموافقة هو الاستغلال المقصود أو الفعلي " (المادة الثانية، الفقرتان 200 و206).

UNODC has developed various tools, such as the 2009 Model Law against Trafficking in Persons, for both common-law and civil-law jurisdictions.
٢٢- وقد استحدث المكتب أدوات مختلفة في هذا الشأن، مثل القانون النموذجي لمكافحة الاتِّجار بالأشخاص الصادر في عام 2009 والصالح لنظامي القانون الأنغلوسكسوني والقانون المدني على السواء.

19. The Special Rapporteur received with interest information concerning the establishment in 2002 of an Inter-Ministerial Anti-Trafficking Task Force with a mandate inter alia, to develop a national plan of action against Trafficking in Persons.
19- وقد تلقت المقررة الخاصة باهتمام معلومات عن إنشاء فرقة عمل مشتركة بين الوزارات معنية بمكافحة الاتِّجار بالأشخاص في عام 2002 أٌسنِدت إليها ولاية تشمل، ضمن ما تشمله، وضع خطة عمل وطنية لمكافحة الاتِّجار بالأشخاص.

Information concerning the establishment in 2002 of an Inter-Ministerial Anti-Trafficking Task Force with a mandate, inter alia, to develop a national plan of action against Trafficking in Persons was received with interest by the Special Rapporteur on trafficking in persons, especially women and children.
9- كما أن المقررة الخاصة المعنية بالاتِّجار بالأشخاص، لا سيما النساء والأطفال، تلقّت باهتمام معلومات عن إنشاء فرقة عمل مشتركة بين الوزارات معنية بمكافحة الاتِّجار بالأشخاص، في عام 2002، من اختصاصاتها وضع خطة عمل وطنية لمكافحة الاتِّجار بالأشخاص().

The commentary to the UNODC Model Law against Trafficking in Persons views article 3 (b) of the Protocol as restating existing international legal norms by which it is " logically and legally impossible to " consent " when one of the means listed in the definition is used. "
17- ويَعتبر التعليق على القانون النموذجي لمكافحة الاتِّجار بالأشخاص الذي أعدّه مكتب الأمم المتحدة المعني بالمخدِّرات والجريمة أنَّ المادة 3 (ب) من البروتوكول تعيد التأكيد على القواعد القانونية الدولية القائمة والتي بمقتضاها " من المستحيل منطقيا وقانونا " الموافقة " عندما تُستخدم إحدى الوسائل المدرجة في التعريف " .

The Office also supported cooperation at the regional and international levels, including through its continued partnership with the League of Arab States and the Arab Initiative for Building National Capacities to Combat Human Trafficking.
ودعم المكتبُ أيضاً التعاونَ على الصعيدين الإقليمي والدولي؛ بعدة وسائل منها شراكته المستمرة مع جامعة الدول العربية ومع المبادرة العربية لمكافحة الاتِّجار بالأشخاص.
