That action is consistent with article 12 of annex IV of the Protocol and is to be undertaken with reference to current IMO guidelines for implementation of the 1973 International Convention for the Prevention of Pollution from Ships and its Protocol of 1978.

4.3.2 MARPOL Regulation 10 of Annex VI to MARPOL defines port State control of operational requirements as follows:

They are also required to develop international rules and standards for the prevention of pollution by dumping and from vessels, and to implement and enforce them at the national level.
كما يُطلب منها أن تضع قواعد ومعايير دولية لمنع التلوث الناجم عن إغراق النفايات من السفن، وتنفيذ تلك القواعد والمعايير وإنفاذها على المستوى الوطني.

Full implementation of MARPOL regulations is dependant upon effective flag State implementation and enforcement.
