6.5 Regarding the claims under article 12, the State party submits that the author has failed to exhaust domestic remedies for the reasons specified above, and that the claim is without merits.

4.1 On 18 June 2012, the State party argued that the communication was inadmissible under article 4, paragraph 1, of the Optional Protocol to the Convention because the author had failed to exhaust domestic remedies by filing a petition for certiorari.
4-1 في 18 حزيران/يونيه 2012، حاججت الدولة الطرف بأن البلاغ غير مقبول بمقتضى الفقرة 1 من المادة 4 من البروتوكول الاختياري للاتفاقية لأن صاحبة البلاغ لم تستنفد سبل الانتصاف المحلية برفع التماس تطلب فيه مراجعة إجراءات القضية.

4.1 On 23 November 2009, the State party challenged the admissibility of the communication, arguing that the author had failed to exhaust all available domestic remedies.
4-1 في 23 تشرين الثاني/نوفمبر 2009، اعترضت الدولة الطرف على مقبولية البلاغ بحجة أن صاحبة البلاغ لم تستنفد سبل الانتصاف المتاحة محلياً.

Accordingly, the State party submits that the author did not express in a sufficiently clear manner her intention to follow the investigation actively by availing herself of her right to complain about the actions of police officers to different institutions, and therefore has not exhausted the domestic remedies before submitting her communication to the Committee.
