Further, it encourages the State party to envisage regulating the burden of proof in civil proceedings involving racial discrimination so that once a person has established a prima facie case that he or she has been a victim of such discrimination, it shall be for the respondent to provide evidence of an objective and reasonable justification for the differential treatment.

50. Discussions of age-related discrimination have now widened from simply identifying age-discriminatory practices in the workplace and in access to benefits and goods and services to addressing the root causes of such discrimination and its perpetuation.
50 - وقد توسعت المناقشات المتعلقة بالتمييز على أساس السن حاليا من مجرد تحديد ممارسات التمييز على أساس السن في مكان العمل وفي فرص الحصول على الفوائد والسلع والخدمات إلى معالجة الأسباب الجذرية لهذا التمييز وإدامته.

4.21 On the basis of the above the State party states that the Government complied with its obligation under article 5 (a) and article 6 of the Convention to ensure that the victims of racial discrimination have effective legal protection and where necessary receive compensation for any damage suffered as a result of such discrimination.
