51- تنشأ انتهاكات الالتزام بالحماية من عدم اتخاذ الدولة كل التدابير اللازمة لحماية الأشخاص الخاضعين لولايتها من انتهاك حقهم في الصحة من جانب أطراف ثالثة.

The State party should take the necessary measures to ensure that individuals under its jurisdiction are guaranteed fair treatment at all stages of the proceedings, including an opportunity for effective, independent and impartial review of decisions on expulsion, return or deportation.
ينبغي أن تتخذ الدولة الطرف التدابير اللازمة لضمان استفادة الأفراد الخاضعين لولايتها من معاملة منصفة في جميع مراحل الإجراءات، بما في ذلك فرصة إجراء مراجعة فعالة ومستقلة ومحايدة لقرارات الطرد أو الإعادة أو الترحيل.

In the context of my mandate it should be noted that the right to life, as protected by Article 6 of the International Covenant on Civil and Political Rights, remains a non-derogable right in all situations, and the Government has the responsibility to protect all persons under its jurisdiction from violation of this right.
