152. In case No. 1069/2002 (Bakhtiyari v. Australia), the Committee recalled its jurisprudence that, in order to avoid any characterization of arbitrariness, detention should not continue beyond the period for which a State party can provide appropriate justification.
152- وفي القضية رقم 1069/2002 (بختياري ضد أستراليا)، ذكّرت اللجنة بآرائها السابقة وهي أنه لتجنب وصف الاحتجاز بأنه تعسفي، ينبغي ألا يتجاوز هذا الاحتجاز الفترة التي يكون بوسع الدولة الطرف تقديم مبرر مناسب بشأنها.

9.2 As to the claims of arbitrary detention, contrary to article 9, paragraph 1, the Committee recalls its jurisprudence that, in order to avoid any characterization of arbitrariness, detention should not continue beyond the period for which a State party can provide appropriate justification.
9-2 وفيما يتعلق بادعاءات الاحتجاز التعسفي، بالمخالفة للفقرة 1 من المادة 9، تذكر اللجنة بآرائها السابقة وهي أنه لتجنب وصف الاحتجاز بأنه تعسفي، ينبغي ألا يتجاوز هذا الاحتجاز الفترة التي يكون بوسع الدولة الطرف تقديم مبرر مناسب بشأنها(18).
