If the State of export is the notifier or if no notification has taken place, the exporter shall be liable for damage until the disposer has taken possession of the hazardous wastes and other wastes.
وإذا كانت دولة التصدير هي الجهة المخطرة أو إذا لم يصدر أي إخطار، فيكون المصدّر مسؤولا عن الضرر إلى أن تؤول النفايات الخطرة والنفايات الأخرى إلى متعهد التصريف.

Later, once the waste is received on the other side, the disposer of the waste is liable for any damage.
وعندما تستقبل النفايات من الجانب الآخر، يكون متعهد التصريف هو المسؤول عن أي ضرر.

Further, in case the waste is declared as hazardous only by the State of import and not export, the importer is also liable until possession is taken by the disposer.
كما أنه في الحالة التي لا تعلن فيها عن خطورة النفايات إلا الدولة المستوردة لا الدولة المصدرة، فإن المستورد يكون مسؤولا أيضا إلى أن يحوزها متعهد التصريف.

1. The person who notifies in accordance with Article 6 of the Convention, shall be liable for damage until the disposer has taken possession of the hazardous wastes and other wastes.
1 - يكون المخطر وفقا للمادة 6 من الاتفاقية، مسؤولا عن الضرر إلى أن تؤول النفايات الخطرة والنفايات الأخرى إلى متعهد التصريف.

Thereafter the disposer shall be liable for damage.
وبعد ذلك يكون متعهد التصريف مسؤولا عن الضرر.

Proof of coverage of the liability of the disposer shall be delivered to the competent authorities of the State of import.
ويسلم إثبات تغطية مسؤولية متعهد التصريف إلى السلطات المختصة في دولة الاستيراد.
