This is an absolute requirement for judges of the court of first instance and justices of the Supreme Court and the courts of second instance or courts of appeal.

45. As a general rule criminal cases are tried in the first instance by the district courts. Severe criminal matters involving jurors are tried by the high courts in the first instance.
٥٤- والقاعدة العامة هي أن القضايا الجنائية تحال إلى المحاكم اﻹقليمية باعتبارها من محاكم الدرجة اﻷولى، بينما تحال القضايا الجنائية الخطيرة التي تتطلب الاستعانة بالمحلفين إلى محاكم الدرجة الثانية التي تقوم هنا بمهام محاكم الدرجة اﻷولى.

وتلزم المادة 223(1) من قانون الإجراءات الجنائية المعدل مؤخراً محاكم الدرجة الثانية بعقد جلسات محاكمة بالنسبة لجميع الطعون المتعلقة بأحكام الإعدام(68).

37. In China, article 223(1) of the recently amended criminal procedure law requires courts of second instance to hold trial hearings for all appeals involving the death penalty.
37 - وفي الصين، تُلزم المادة 223 (1) من قانون الإجراءات الجنائية المعدل مؤخراً محاكم الدرجة الثانية بعقد جلسات محاكمة في جميع دعاوى لاستئناف أحكام الإعدام.

The fact that it has to be presented to courts of second instance (which are located only in departmental capitals and therefore a long way from most towns) and that these courts delegate its execution to so-called executing officers, who in many cases are neither judges nor lawyers, means that this procedure is completely inappropriate for safeguarding against violations of fundamental rights.
