Article 23: If a State property including a segregated State property is entrusted by the State to a State enterprise for commercial purposes, the State cannot invoke immunity from a measure of constraint before a Court of a forum State in respect of that State property.

Where the law of the requested State Party so requires, the accused person shall be entitled to challenge the request for arrest and surrender in the court of the requested State Party on the ground that the evidence submitted in support of the request would not be sufficient to commit him to trial for such an offence in a Court of the requested State.
يحق للمتهم، حيثما يقتضي ذلك قانون الدولة الطرف المطلوب منها التسليم، أن يطعن في طلب القبض والتسليم لدى محكمة الدولة الطرف المطلوب منها التسليم استنادا الى عدم كفاية اﻷدلة المقدمة دعما لطلب التسليم لتقديمه للمحاكمة على هذا الجرم في محكمة تابعة للدولة المطلوب منها التسليم.

)ج( عدم كفاية اﻷدلة المقدمة دعما لطلب التسليم لتقديمه للمحاكمة على هذا الجرم في محكمة تابعة للدولة المطلوب منها التسليم.

2. Article 2 of the draft convention provides: “A ship may be arrested ... only by or under the authority of a Court of the Contracting State in which the arrest is made”, whereas article 110 of the Moroccan Maritime Code stipulates: “The arrest of a ship may be effected at any time either under an enforceable instrument or under the authority of the competent court ...”.
2- وتنص المادة 2من الاتفاقية على أنه " لا يجوز حجز سفينة ما ... إلا عن طريق أو تحت سلطة محكمة تابعة للدولة المتعاقدة التي يتم فيها الحجز " بينما تنص المادة 110 من التقنين البحري المغربي على أنه:

Moreover, the same article 110 of the Moroccan Maritime Code conflicts with article 2, paragraph 1, of the draft convention, which stipulates that a ship may be arrested only by or under the authority of a Court of the Contracting State in which the arrest is made, while the Moroccan Maritime Code also permits such arrest on the basis of an enforceable instrument.

The proposed International Criminal Court should serve as the tribunal of the international community to try and punish such individuals and, the sooner it starts functioning, the better it will be for humanity at large.
