The Claimant also seeks compensation for the cost of spare parts which were transferred from Jubail to Al Khafji to effect the repairs.
124- ويلتمس صاحب المطالبة أيضا تعويضا عن تكاليف قطع الغيار التي تم نقلها من مدينة جبيل إلى مدينة الخفجي لإجراء الإصلاحات.

The Claimant asserts that the staff members were transferred to the Claimant's housing facilities in Al Khobar and Jubail, twelve days before the invasion of Al Khafji, as a protective measure.

The Panel finds that the evidence is not sufficient to demonstrate that the damage to the vehicle arose as a result of military operations in Al Khafji and therefore recommends no award of compensation in respect thereof.
128- ويستنتج الفريق أن الأدلة ليست كافية لإثبات أن الضرر الذي لحق بالعربة قد نتج عن العمليات العسكرية التي حدثت في مدينة الخفجي ويوصي من ثم بعدم دفع تعويض عنها.

Iraq, stating that its forces entered Al Khafji on 29 January 1991, asserts that it is unreasonable to seek compensation for loss of production at the Al Khafji plant as well as for the costs of evacuating the plant's personnel.
145- ويدعي العراق الذي يصرح بأن قواته قد دخلت مدينة الخفجي في 29 كانون الثاني/يناير 1991 أنه لا يعقل التماس تعويض عن الخسارة الناتجة عن توقف الإنتاج في مصنع الخفجي وعن تكاليف إجلاء موظفي المصنع.

The Panel finds on the basis of the evidence that the decision to grant the bonus payments was made in July 1991 and that the payments were partly intended as an inducement to staff to return to Al Khafji after 2 March 1991.
ويستنتج الفريق على أساس الأدلة أن القرار بمنح المكافآت قد اتخذ في تموز/يوليه 1991 وأن المدفوعات كانت ترمي جزئيا إلى حفز الموظفين وحثهم على العودة إلى مدينة الخفجي بعد 2 آذار/مارس 1991.

Iraq asserts that as the generators were purchased in September 1990, the purchase was not related to the military operations which took place in Al Khafji.
172- ويدعي العراق أن شراء أجهزة توليد الكهرباء قد تم في أيلول/سبتمبر 1990 وأنه لم يكن له من ثم صلة بالعمليات العسكرية التي وقعت في مدينة الخفجي.

For the reasons stated at paragraph above, the Panel finds that loss or damage of other tangible property arising as a result of military operations in Al Khafji is, in principle, compensable.
232- للأسباب الوارد ذكرها في الفقرة 17 أعلاه، يستنتج الفريق أن الممتلكات المادية الأخرى التي فقدت أو تضررت نتيجة للعمليات العسكرية التي وقعت في مدينة الخفجي قابلة من حيث المبدأ للتعويض.

The Claimant asserts that the vehicles were purchased in accordance with the emergency procedures referred to at paragraphs to above, and further, that the vehicles that were parked next to the telephone exchange building in Al Khafji were lost, stolen or destroyed as a result of the military operations that took place in that town.
وتزعم أن شراء العربات قد تم وفقا لإجراءات الطوارئ المشار إليها في الفقرات 198 إلى 202 أعلاه، وأن العربات التي كانت واقفة كذلك بالقرب من مبنى المقسم في مدينة الخفجي قد فقدت أو سرقت أو أتلفت نتيجة للعمليات العسكرية التي حدثت في هذه المدينة.
