The author, as the Chairperson of Civil Initiatives, had been found guilty of having used, from 14 April to 13 August 2001, untied foreign aid (computer equipment) for purposes proscribed by the Presidential Decree, namely, the preparation for and conduct of the Presidential elections.
فقد أدين صاحب البلاغ، بصفته رئيس جمعية المبادرات المدنية، بأنه استعمل في الفترة الممتدة من 14 نيسان/ أبريل حتى 13 آب/أغسطس 2001 مساعدة أجنبية غير مشروطة (معدات حاسوبية) في أغراض يحظرها المرسوم الرئاسي، أي التحضير للانتخابات الرئاسية وتسييرها.

Consequently, the communication is admissible ratione materiae, insofar as the proceedings related to the use of foreign aid (computer equipment) for the preparation for and monitoring of the elections, fall within the ambit of " the determination " of a " criminal charge " under article 14, paragraph 1, of the Covenant.

10.5 The Committee further notes that the activity for which the author was held responsible, namely, the use of computer equipment, received as untied foreign aid, for elections monitoring and related publicity activities falls within the scope of article 25, paragraph (a), of the Covenant, which recognizes and protects the right of every citizen to take part in the conduct of public affairs.
10-5 وتشير اللجنة أيضاً إلى أن النشاط الذي عُد صاحب البلاغ مسؤولاً عنه، أي استخدام معدات حاسوبية وردت في شكل مساعدة أجنبية غير مشروطة، لمراقبة الانتخابات وما يتعلق بها من أنشطة دعائية، يندرج في نطاق الفقرة (أ) من المادة 25 من العهد، التي تعترف بحق كل مواطن في المشاركة في إدارة الشأن العام وتحميه.

The first issue is whether the imposition of a fine on the author for the use by Civil Initiatives of the computer equipment, received as untied foreign aid, for the preparation for and monitoring of the elections, as well as the confiscation of the computer equipment in question, amounted to a restriction of the author's right to freedom of association, and whether such restriction was justified.
أما الأولى فتتعلق بما إذا كان فرض الغرامة على صاحب البلاغ بسبب استعمال جمعية " المبادرات المدنية " معدات حاسوبية تلقتها في إطار مساعدة أجنبية غير مشروطة، لتحضير الانتخابات ومراقبتها، ومصادرة هذه المعدات الحاسوبية، يبلغان حد تقييد حق صاحب البلاغ في حرية تكوين الجمعيات، وما إذا كان هذا التقييد مبرَّراً.

It further noted that Tajikistan was in receipt of significant foreign assistance and had incurred foreign debts during the recent past, on which it had not been in a position to make significant payments.
