30- بينما جرى التسليم بأن مستندات النقل غير القابلة للتداول التي يشترط تسليمها غير شائعة في جميع الولايات القضائية، ارتأى الفريق العامل عموما أن مشروع المادة 47 مفيد في الحالات التي توجد فيها تلك المستندات، وقرّر استبقاء مشروع المادة المذكور مع حذف المعقوفتين المحيطتين بنص ذلك الحكم.

In response to the question whether non-negotiable transport documents that required surrender should also be included in paragraph 2 of draft article 56, the Working Group agreed that they should be included, and that they should be treated in a similar fashion to that of negotiable transport documents.
106- وردّا على سؤال بشأن ما إذا كان ينبغي أن تُدرَج أيضا في الفقرة 2 من مشروع المادة 56 مستندات النقل غير القابلة للتداول التي يُشترط تسليمها، اتفق الفريق العامل على ضرورة إدراجها ومعاملتها معاملةَ مستندات النقل القابلة للتداول.

It was observed that paragraph 2 of draft article 56 provided that variations to the contract of carriage were required to be stated in negotiable transport documents or incorporated into negotiable electronic transport records, but that their inclusion in non-negotiable transport documents or electronic transport records was at the option of the controlling party.
105- لوحظ أن الفقرة 2 من مشروع المادة 56 تنص على وجوب ذكر أيّ تغييرات تُدخَل على عقد النقل في مستندات النقل القابلة للتداول أو إدراجها في سجلات النقل الإلكترونية القابلة للتداول، لكن إدراجها في مستندات النقل غير القابلة للتداول أو في سجلات النقل الإلكترونية غير القابلة للتداول لا يكون إلا إذا اختار الطرف المسيطر ذلك.
