A question was raised whether it might be desirable to adjust the title of draft article 49 to reflect the fact that the negotiable transport document or electronic transport record might, in some cases, not require surrender.
162- واستُفسر عما إذا كان من المستصوب تعديل عنوان مشروع المادة 49 حتى يتبيّن منه أنّ مستند النقل القابل للتداول أو سجل النقل القابل للتداول قد لا يشترط في بعض الحالات تسليمه.

2. A holder that is not the shipper and that exercises any right under the contract of carriage assumes any liabilities imposed on it under the contract of carriage to the extent that such liabilities are incorporated in or ascertainable from the negotiable transport document or the negotiable electronic transport record.
2- يتحمّل الحائز الذي ليس هو الشاحن والذي يمارس أي حق بمقتضى عقد النقل، ما يفرضه عليه عقد النقل من مسؤوليات، متى كانت تلك المسؤوليات مدرجة في مستند النقل القابل للتداول أو سجل النقل الإلكتروني القابل للتداول أو يمكن الاستدلال عليها في ذلك المستند أو السجل.

2. Without prejudice to article 48, paragraph 1, if the negotiable transport document or the negotiable electronic transport record expressly states that the goods may be delivered without the surrender of the transport document or the electronic transport record, the following rules apply:

2. Without prejudice to article 48, paragraph 1, if the negotiable transport document or the negotiable electronic transport record expressly states that the goods may be delivered without the surrender of the transport document or the electronic transport record, the following rules apply:

It was observed that the scheme set out in subparagraphs (d), (e), (f) and (g) of draft article 49 was intended to address the current problem of delivery of the goods without presentation of the negotiable transport document or electronic transport record.
52- لوحظ أن المخطط المبيّن في الفقرات الفرعية (د) و(ﻫ) و(و) و(ز) من مشروع المادة 49 يُقصد به تناول المشكلة الراهنة فيما يتعلق بتسليم البضاعة بدون إبراز مستند النقل القابل للتداول أو سجل النقل الإلكتروني القابل للتداول.

There was some support for the view that the establishment of such a system undermined the traditional bill of lading system by institutionalizing the undesirable practice of delivery without presentation of the negotiable transport document or electronic transport record.
53- وكان هناك قدر من التأييد للرأي الذي مفاده أن إنشاء نظام من هذا القبيل يقوِّض نظام سندات الشحن التقليدي بإضفاء طابع مؤسسي على الممارسة غير المرغوبة المتمثلة في التسليم بدون إبراز مستند النقل القابل للتداول أو سجل النقل الإلكتروني القابل للتداول.

234. It was indicated that draft paragraph 49 (a) provided that the holder of a negotiable transport document or a negotiable electronic transport record was entitled to claim delivery of the goods upon surrender of that document or record.
234- أُفيد بأن مشروع الفقرة 49 (أ) ينص على أنه يحق لحائز مستند النقل القابل للتداول أو سجل النقل الإلكتروني القابل للتداول أن يطالب بتسلّم البضاعة عند تسليم ذلك المستند أو السجل.

236. It was indicated that draft paragraph 49 (b) dealt with cases in which the cargo had arrived at destination but the holder of the negotiable transport document or negotiable electronic transport record did not claim delivery of it.
236- أُفيد بأن مشروع الفقرة 49 (ب) يتناول الحالات التي تكون فيها البضاعة المشحونة قد وصلت إلى المقصد لكن حائز مستند النقل القابل للتداول أو سجل النقل الإلكتروني القابل للتداول لم يطالب بتسلّمها.

(a) The holder of the negotiable transport document or negotiable electronic transport record is entitled to claim delivery of the goods from the carrier after they have arrived at the place of destination, in which event the carrier shall deliver the goods at the time and location referred to in article 43 to the holder:
(أ) يحق لحائز مستند النقل القابل للتداول أو سجل النقل الإلكتروني القابل للتداول أن يطالب بتسلم البضائع من الناقل بعد وصولها إلى مكان المقصد، ويسلم الناقل البضائع إلى الحائز في هذه الحالة في الوقت والمكان المشار إليهما في المادة ٤3:

(e) Notwithstanding subparagraphs 2 (b) and 2 (d) of this article, a holder that becomes a holder after such delivery, and that did not have and could not reasonably have had knowledge of such delivery at the time it became a holder, acquires the rights incorporated in the negotiable transport document or negotiable electronic transport record.

It was generally recognized that the system established by subparagraphs (d), (e), (f) and (g) of draft article 49 intended to protect in such cases both the carrier and the third party acquirer of the negotiable transport document or electronic transport record.
