Such a wording is to be preferred to a " without prejudice " clause, because it better captures the residual nature of the draft articles in relation to special rules of international law, and because it is more in line with the wording of similar provisions recently adopted by the Commission, for example, article 17 of its draft articles on diplomatic protection, which reads as follows:
