In response, it was observed that the proposed text had been crafted broadly to avoid including details that might conflict with other regulations and that it was the understanding of the proponents that the guide would specify that the provisions were subject to applicable regulations in each enacting State.

While each enacting State will need to decide to what extent special identifier rules are needed for particular cases, possible examples include a secured creditor that is subject to insolvency proceedings, a trustee and a representative of a deceased person.

وبضم الاجراءات التي ينص عليها في القانون النموذجي في التشريعات الوطنية ﻷي دولة مشترعة فيما يتعلق بتلك الحالات التي يختار اﻷطراف فيها استعمال الوسائل الالكترونية للاتصالات ، فان أي دولة مشترعة قد تخلق بيئة محايدة ﻷجهزة الاتصال .

As to the possibility of referring to banks or insurance companies in that context, the proposed solution had been not to refuse recognition of proceedings covering banks, as that would mean refusal of cooperation, but to leave bank insolvency outside the scope of model law, although an enacting State could bring banks under the law if it wished.
أما عن إمكانية اﻹشارة إلى المصارف وشركات التأمين في هذا السياق ، فكان الحل المقترح هو عدم رفض الاعتراف باﻹجراءات التي تشمل المصارف ، إذا كان ذلك سوف يعني رفض التعاون ، وإنما ترك إعسار المصارف خارج نطاق القانون النموذجي ، إلا أنه يمكن لدولة مشترعة أن تشمل المصارف في القانون إذا كانت راغبة في ذلك .

The Model Law applies to all kinds of data messages to which a legally significant electronic signature is attached, and nothing in the Model Law should prevent an enacting State from extending the scope of the Model Law to cover uses of electronic signatures outside the commercial sphere.
