٤١ - واستطرد قائلا إن أعمال اللجنة تجسدت بصورة ملموسة في الاستنتاجات التي توصلت إليها اللجنة في دورتها الثامنة والعشرين، التي اعتمد فيها مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة.

Without wishing to dissociate himself from the consensus which had emerged on the draft Convention on Independent Guarantees and Stand-by Letters of Credit, his delegation would not be able to take a position on the matter as it had not yet received instructions from its Government.
وقال إنه لا يرغب في أن ينسلخ عن الاجماع الذي ظهر حول مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة، إلا أن وفده لن يستطيع أن يتخذ موقفا بشأن هذه المسألة ﻷنه لم يتلق بعد تعليمات من حكومته.

30. His delegation welcomed the completion of work on the draft Convention on Independent Guarantees and Stand-by Letters of Credit, although it felt that it would have been preferable if the draft articles had taken the form of a model law rather than an international convention.
٣٠ - وأعرب عن اغتباط الوفد اﻹيراني للانتهاء من إعداد مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة، وأن وفده كان يُفضل، مع ذلك، لو أن مشروع المواد اتخذ شكل قانون نموذجي بدلا من اتفاقية دولية.

1. Mr. NAGY (Hungary) congratulated the United Nations Commission on International Trade Law (UNCITRAL) on concluding its consideration of the draft Convention on Independent Guarantees and Stand-by Letters of Credit at its twenty-eighth session.

30. Mr. MUBARAK (Egypt) said that the primary achievement of the twenty-eighth session of UNCITRAL had been the conclusion of the Commission's consideration and review of the draft Convention on Independent Guarantees and Stand-by Letters of Credit.
٣٠ - السيد مبارك )مصر(: قال إن أهم ما أنجزته اللجنة في دورتها الثامنة والعشرين هو الانتهاء من دراسة ومراجعة مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة.

55. Mr. LAVALLE VALDÉS (Guatemala) said that he wished to propose various amendments to the draft Convention on Independent Guarantees and Stand-by Letters of Credit.
٥٥ - السيد لافالي فالديس )غواتيمالا(: قال إنه يود أن يقترح إدخال عدة تعديلات على مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة.

58. Mr. RAO (India) said that the main achievement of the twenty-eighth session of UNCITRAL had been the adoption of the draft Convention on Independent Guarantees and Stand-by Letters of Credit.
٥٨ - السيد راو )الهند(: قال إن أهم نتيجة حققتها اللجنة في دورتها الثامنة والعشرين تمثلت في اعتماد مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة.

6. Mr. SIDI ABED (Algeria) said that the draft Convention on Independent Guarantees and Stand-by Letters of Credit, which had been finalized after 11 sessions, would make it easier to achieve uniformity in that field and reduce disparities between various legal systems.
٦ - السيد سيدي عابد )الجزائر(: قال إن مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة، الذي أنجز بعد ١١ دورة، سيساعد في التوصل الى توحيد الممارسات المعمول بها في هذا المجال، حيث أنه سيقلل من التباينات القائمة بين مختلف النظم القانونية.

Mr. POERNOMO (Indonesia) said that his delegation had been pleased to note the agreement reached on the major issues addressed by the draft Convention on Independent Guarantees and Stand-by Letters of Credit, as well as the regime of flexibility contained in the instrument, which provided the means to wholly or partially opt out of it.
٣١ - السيد بورنومو )اندونيسيا(: قال إنه لمن دواعي الارتياح أن يتم التوصل الى اتفاق بشأن أهم المسائل التي تناولها مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة فضلا عما يتسم به هذا الصك من نظام مرن يتيح إمكانية نقضه كليا أو جزئيا.

19. Mr. SÁNCHEZ (Spain), referring to the draft Convention on Independent Guarantees and Stand-by Letters of Credit, said that he attached great importance to the suggested procedure for adopting the text, namely that it should be submitted to the General Assembly and considered with a view to its adoption so that it might subsequently be opened for signature by States.
١٩ - السيد سانشيس )اسبانيا(: أشار الى مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة، فقال إنه يولي اهتماما كبيرا باﻹجراءات التي اقترح اتباعها لاعتماد النص والقاضية بعرضه على الجمعية العامة وتوصيته بالنظر فيه بغية اعتماده ليفتح فيما بعد باب توقيع الدول عليه.

40. Mrs. FLORES (Mexico) welcomed the completion of the draft Convention on Independent Guarantees and Stand-by Letters of Credit, which reconciled the need to uphold the contractual autonomy of the parties with the need for a legal framework that would lend certainty to those operations.
٤٠ - السيدة فلورس )المكسيك(: قالت إن بلدها يرحب مع الارتياح بالانتهاء من مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة التي توفق بين ضرورة اﻹبقاء على مبدأ استقلالية إرادة اﻷطراف المتعاقدة وضرورة الاعتماد على إطار قانوني يكسب عمليات من هذا القبيل طابع اليقين.

45. Mr. STRAUSS (Canada) said that during the current year the UNCITRAL Working Group on International Contract Practices, under its Canadian Chairman, had completed its work on the draft Convention on Independent Guarantees and Stand-by Letters of Credit.
٤٥ - السيد ستراوس )كندا(: قال إن فريق الاونسيترال العامل المعني بالممارسات التعاقدية الدولية قد أنهى في العام الحالي، بقيادة رئيسه الكندي، أعماله بشأن مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة.

Mr. GOH (Chairman of the United Nations Commission on International Trade Law (UNCITRAL)), introducing the report of UNCITRAL on the work of its twenty-eighth session, said that the session had been marked by the adoption of the draft Convention on Independent Guarantees and Stand-by Letters of Credit.
١ - السيد غوه )رئيس لجنة اﻷمم المتحدة للقانون التجاري الدولي(: عرض تقرير لجنة القانون التجاري الدولي عن أعمال دورتها الثامنة والعشرين فقال إن تلك الدورة تميزت باعتماد مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة.

Mr. LEONI (Brazil) expressed satisfaction that the Working Group on International Contract Practices had concluded the preparation of the draft Convention on Independent Guarantees and Stand-by Letters of Credit, which the Brazilian Government believed was a valuable legal instrument for universal use.
١٤ - السيد ليوني )البرازيل(: أعرب عن اغتباطه لانتهاء الفريق العامل المعني بالممارسات التعاقدية الدولية من وضع مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة، وقال إن الحكومة البرازيلية ترى في مشروع تلك الاتفاقية صكا له قيمته يُبشر بالتطبيق على نطاق عالمي.

7. Mr. BELLOUKI (Morocco) noted with satisfaction the completion of work on the draft Convention on Independent Guarantees and Stand-by Letters of Credit, which ensured an acceptable balance between the rights and obligations of the parties and different legal systems and international practice.
٧ - السيد بلوقي )المغرب(: لاحظ بارتياح اكتمال العمل بشأن مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة، التي تكفل وجود توازن مقبول بين حقوق والتزامات اﻷطراف والنظم القانونية المختلفة والممارسة الدولية.

10. Mr. LEGAL (France) welcomed the adoption of the draft Convention on Independent Guarantees and Stand-by Letters of Credit and said that his delegation was prepared to adopt in its current form the text prepared by UNCITRAL at its twenty-eighth session.
١٠ - السيد ليغال )فرنسا(: رحب باعتماد مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة. وقال إن وفده على استعداد للموافقة على النص الذي أعدته اللجنة في دورتها الثامنة والعشرين بشكله الراهن.

34. Mr. SMEJKAL (Czech Republic) welcomed the fact that UNCITRAL had completed its work on the draft Convention on Independent Guarantees and Stand-by Letters of Credit and wholeheartedly endorsed the Commission's recommendation that the General Assembly should adopt the Convention by means of a resolution at its current session.
٣٤ - السيد سميجكال )الجمهورية التشيكية(: رحﱠب بإكمال اللجنة، أعمالها بشأن مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة وأعرب عن تأييده المطلق لتوصية اللجنة بأن تعتمد الجمعية العامة الاتفاقية بموجب قرار تتخذه في دورتها الراهنة.

44. Mr. KANEHARA (Japan) said that he had no objection to the adoption of the draft Convention on Independent Guarantees and Stand-by Letters of Credit by a General Assembly resolution, which would make it unnecessary to convene a diplomatic conference, even if the draft itself was not entirely satisfactory.
٤٤ - السيد كانيهارا )اليابان(: قال إنه ليس لديه اعتراض على اعتماد مشروع الاتفاقية المتعلقة بالكفالات المستقلة وخطابات الاعتماد الضامنة بقرار من الجمعية العامة، مما سيجعل من غير الضروري عقد مؤتمر دبلوماسي، حتى وإن كان المشروع نفسه ليس مرضيا للغاية.
