The present draft articles contain little progressive development. Indeed a number of respondent States have criticized them on this ground.

With regard to service of process under the present draft articles, and according to the commentary of the International Law Commission on this article, the Commission does not seem to intend to establish an independent framework for service of process by writ or other document instituting a proceeding against a State, which is completely different from the one conducted against a private person.
وفيما يتعلق بتبليغ صحيفة الدعوى بموجب مشروع المواد الحالي ووفقا لتعليق لجنة القانون الدولي على هذه المادة لا يبدو أن اللجنة تعتزم إنشاء إطار مستقل لتبليغ صحيفة الدعوى بورقة قضائية أو بوثيقة أخرى تقام بها دعوة ضد دولة وهو أمر مختلف تماما عن اﻹطار المتبع ضد الشخص العادي.

“The present draft articles apply to unilateral legal acts formulated by States which have international effects.”

For the purposes of the present draft articles:

The argument in favour of uniformity in approach is further supported by the fact that, where the predecessor State is a party to any of the above-mentioned two Conventions, their provisions could be applicable, by virtue of the rules of succession in respect of treaties, to the successor State, including as regards the situation envisaged in paragraph 2 of article 1 of the present draft articles.

(12) Paragraph 2 is not intended to imply that all provisions of the present draft articles have the character of strict legal obligations for States concerned.
)١٢( وليس القصد من الفقرة ٢ أن توحي ضمنيا بأن ﻷحكام مشروع المواد الحالي طابع التزامات قانونية صارمة تقع على عاتق الدول المعنية.

First, such a provision formed part of the articles on State responsibility, and there was no reason not to include a similar clause in the current draft articles.
أولا، لأن هذا الحكم يشكل جزءا من المواد المتعلقة بمسؤولية الدولة، ولا يوجد سبب لعدم إدراج حكم مماثل في مشروع المواد الحالي.

However, it must be clarified whether those special rules took precedence over the draft articles only if the person concerned enjoyed a broader scope of immunity under those special rules or also if the special rules provided a lesser degree of immunity than the current draft articles.
إذ ينبغي توضيح إن كان لتلك القواعد الخاصة أولوية على مشروع المواد في حالة تمتع الشخص المعني بنطاق أوسع من الحصانة بموجب تلك القواعد الخاصة أو إن كانت تلك القواعد الخاصة توفر درجة حصانة أقل مما يوفره مشروع المواد الحالي.
