Each State Party may adopt such legislative or other measures as may be necessary to take into consideration, under such terms as and for the purpose that it deems appropriate, any previous conviction in another State of an alleged offender for the purpose of using such information in criminal proceedings relating to an offence covered by this Convention.
يجوز لكل دولة طرف أن تعتمد ما قد يلزم من تدابير تشريعية أو تدابير أخرى لكي تأخذ بعين الاعتبار، وفقا لما تراه ملائما من شروط، وللغرض الذي تعتبره ملائما، أي حكم ادانة صدر سابقا بحق الجاني المزعوم في دولة أخرى، بغية استخدام تلك المعلومات في اجراءات جنائية ذات صلة بجرم مشمول بهذه الاتفاقية.

“Each State Party shall adopt legislative and other measures, as may be necessary, to establish as criminal offences the conduct constituting the perpetration of any crime covered by this Convention from its own territory in the territory of any other State by an organized criminal group or a member thereof.”
" على كل دولة طرف أن تعتمد ما قد يلزم من تدابير تشريعية وغير تشريعية لتجريم أي سلوك يمثل ارتكابا ﻷي جرم مشمول بهذه الاتفاقية انطلاقا من اقليمها في اقليم أي دولة أخرى من جانب جماعة اجرامية منظمة أو من جانب عضو فيها . "

1. Each State Party shall make the commission of an offence covered by this Convention liable to sanctions that take into account the grave nature of those offences.
١ - على كل دولة طرف أن تجعل ارتكاب أي جرم مشمول بهذه الاتفاقية عرضة لجزاءات تراعى فيها خطورة ذلك الجرم .

Each State Party shall adopt such legislative or other measures as may be necessary to take into consideration, under such terms as and for the purpose that it deems appropriate, any previous conviction in another State of an alleged offender for the purpose of using such information in criminal proceedings relating to an offence covered by this Convention.
تعتمد كل دولة طرف ما قد يلزم من تدابير تشريعية أو تدابير أخرى لكي تأخذ بعين الاعتبار، وفقا لما تراه ملائما من شروط، وللغرض الذي تعتبره ملائما، أي حكم إدانة صدر سابقا بحق الجاني المزعوم في دولة أخرى، بغية استخدام تلك المعلومات في إجراءات جنائية ذات صلة بجرم مشمول بهذه الاتفاقية.

2. States Parties shall consider providing for the possibility, in appropriate cases, of mitigating punishment of an accused person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.
2- تنظر الدول الأطراف في إتاحة إمكانية اللجوء، في الحالات المناسبة، إلى تخفيف عقوبة الشخص المتهم الذي يقدم عوناً كبيراً في إجراءات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

1. Each State Party shall consider providing for the possibility, in appropriate cases, of mitigating punishment of an accused person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.
1- تنظر كل دولة طرف في إتاحة إمكانية اللجوء، في الحالات المناسبة، إلى تخفيف عقوبة الشخص المتهم الذي يقدم عونا كبيرا في إجراءات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

2. Each State Party shall consider providing for the possibility, in appropriate cases, of mitigating punishment of an accused person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.
2- تنظر كل دولة طرف في أن تتيح، في الحالات المناسبة، إمكانية تخفيف عقوبة المتهم الذي يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

3. Each State Party shall consider providing for the possibility, in accordance with fundamental principles of its domestic law, of granting immunity from prosecution to a person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.
3- تنظر كل دولة طرف في أن تتيح، وفقا للمبادئ الأساسية لقانونها الداخلي، إمكانية منح الحصانة من الملاحقة القضائية لأي شخص يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

[2. Each State Party shall consider encouraging its nationals and other persons with a habitual residence in its territory to report to the national investigating and prosecuting authorities the commission of a criminal offence covered by this Convention.]
[2- تنظر كل دولة طرف، في تشجيع رعاياها وغيرهم من الأشخاص الذين يوجد مكان إقامتهم المعتاد في اقليمها على إبلاغ السلطات الوطنية المعنية بالتحقيق والملاحقة عن ارتكاب فعل إجرامي مشمول بهذه الاتفاقية.]

2- تنظر كل دولة طرف، في تشجيع رعاياها وغيرهم من الأشخاص الذين يوجد مكان إقامتهم المعتاد في اقليمها على إبلاغ السلطات الوطنية المعنية بالتحقيق والملاحقة في ارتكاب فعل إجرامي مشمول بهذه الاتفاقية والملاحقة عليه.

3. Each State Party shall consider providing for the possibility, in accordance with fundamental principles of its domestic law, of granting immunity from prosecution to a person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.
3- تنظر كل دولة طرف في إمكانية منح الحصانة من الملاحقة القضائية، وفقا للمبادئ الأساسية لقانونها الداخلي، لأي شخص يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

2. Each State Party shall consider encouraging its nationals and other persons with a habitual residence in its territory to report to the national investigating and prosecuting authorities the commission of a criminal offence covered by this Convention.
2- تنظر كل دولة طرف، في تشجيع رعاياها وغيرهم من الأشخاص الذين يوجد مكان إقامتهم المعتاد في اقليمها على إبلاغ السلطات الوطنية المعنية بالتحقيق والملاحقة عن ارتكاب فعل إجرامي مشمول بهذه الاتفاقية.

(a) Proceeds derived from an offence established in article(s) [...] [alternatively: from an offence covered by this Convention] or property the value of which corresponds to that of such proceeds;
)أ( العائدات المتأتية من جرم مقرر في المادة )المواد( ]...[ ]أو بدلا من ذلك : جرم مشمول بهذه الاتفاقية[ أو ممتلكات تعادل قيمتها قيمة تلك العائدات ؛

“Each State Party shall take effective measures to ensure that its territory, or any facility therein, is not allowed to be used by an organized criminal group, or a member thereof, to plan or perpetrate any crime covered by this Convention in any other country.”
" على كل دولة طرف أن تتخذ تدابير فعالة لضمان عدم السماح باستخدام اقليمها ، أو أي مرفق موجود فيه ، من جانب جماعة اجرامية منظمة ، أو أي عضو فيها ، لتخطيط أو ارتكاب جرم مشمول بهذه الاتفاقية في بلد آخر . "

1. Each State Party shall make the commission of an offence covered by this Convention The use of the phrase “an offence covered by this Convention” should be reviewed once the scope of the Convention has been determined.
١ - يتعين على كل دولة طرف أن تجعل ارتكاب أي جرم مشمول بهذه الاتفاقيةحالما يتم تحديد نطاق الاتفاقية ، ينبغي اعادة النظر في استخدام عبارة " جرم مشمول بهذه الاتفاقية " .

" يتعين على كل دولة طرف أن تتخذ تدابير فعالة لضمان عدم السماح باستخدام اقليمها ، أو أي مرفق موجود فيه ، من جانب جماعة اجرامية منظمة ، أو أي عضو فيها ، لتخطيط أو ارتكاب جرم مشمول بهذه الاتفاقية في بلد آخر . "

" يتعين على كل دولة طرف أن تعتمد ما قد يلزم من تدابير تشريعية وغير تشريعية لتجريم أي سلوك يمثل ارتكابا ﻷي جرم مشمول بهذه الاتفاقية انطلاقا من اقليمها في اقليم أي دولة أخرى من جانب جماعة اجرامية منظمة أو من جانب عضو فيها . "

11. Each State Party shall take appropriate measures, consistent with its legal system, to ensure that a person who is charged with or convicted of an offence that is the subject of this Convention and who is found within its territory is present at the necessary criminal proceedings.
١١ - على كل دولة طرف أن تتخذ ما تراه مناسبا من تدابير تتفق ونظامها القانوني لضمان حضور أي شخص متهم أو مدان بارتكاب جرم مشمول بهذه الاتفاقية ، يوجد داخل إقليمها ، اﻹجراءات الجنائية اللازمة .تساءلت عدة وفود عن دواعي حضور الشخص المدان بجرم ما " الاجراءات الجنائية اللازمة " .
