The Working Group requested the Secretariat to make adjustments to both variants so as to ensure that the " accessibility standards " would apply to any means of publication and communication chosen.
14- وطلب الفريق العامل إلى الأمانة أن تدخل تعديلات على كلا البديلين بحيث تكفل انطباق " معايير سهولة المنال " على أي وسيلة مختارة من وسائل النشر والاتصال.

That is, the procuring entity could choose either paper or electronic publication, or both, without being required to justify the choice made, provided that the means of publication chosen complied with certain " accessibility standards " .

It was proposed, in the alternative, that the " accessibility standards " might be set out elsewhere in the Model Law, and therefore that the text of the proposed article 4 bis could address the first two elements alone.

However, the Working Group noted that the " accessibility standards " should apply to all procurement phases, and that one article should address all phases.

The Working Group requested the Secretariat to provide draft accessibility standards for its consideration at a future session, which standards could be based on proposed paragraph 3 of article 24 contained in document A/CN.9/WG.I/WP.34/Add.2.

It was noted that one aspect of the controls stated that any means of communication could be used " provided that the enacting State or procuring entity is satisfied that such use complies with the [accessibility standards] " .
وأُشير إلى أن أحد جوانب الضوابط يبيِّن أنه يمكن استخدام أي وسيلة من وسائل التخاطب " شريطة أن تكون الدولة المشترعة أو الجهة المشترية مقتنعة بأن هذا الاستخدام يمتثل لـ[معايير سهولة المنال] " .

The Working Group decided that it would continue its deliberations on the basis of Variant B for draft article 4 bis, and requested the Secretariat to reformulate Variant B to take account of these proposals, in particular to revise the text expressly to accommodate all forms of communication, and without a statement of the accessibility standards within that article.
26- وقرّر الفريق العامل أن يواصل مداولاته على أساس البديل باء لمشروع المادة 4 مكررا، وطلب إلى الأمانة أن تعيد صوغ البديل باء لمراعاة تلك الاقتراحات، ولا سيما تنقيح النص، بالتحديد لكي يشمل جميع أشكال التخاطب، ودون ذكر معايير سهولة المنال ضمن تلك المادة.

The general view was that the provisions on the " accessibility standards " currently contained in article 4 bis should be dealt with as a separate consideration, and that they should clearly address all forms of communication, and not just electronic ones.
28- كان الرأي السائد هو أن الأحكام بشأن " معايير سهولة المنال " ، الواردة حاليا في المادة 4 مكررا، ينبغي أن تعالَج كاعتبار منفصل، وينبغي أن تتناول بوضوح جميع أشكال الخطابات لا الخطابات الإلكترونية فحسب.

As regards subparagraph (b), it was considered that the subparagraph should be deleted, as its content was not relevant to " accessibility standards. "
وفيما يتعلق بالفقرة الفرعية (ب)، رئي أن تحذف الفقرة الفرعية لعدم صلة محتواها بموضوع " معايير سهولة المنال " .

Noting that no final determination on the question had been made, the Working Group requested the Secretariat to prepare a revised draft for the " accessibility standards " , based on the text set out in paragraph 30 above, incorporating the comments made at the current session, and to revise the proposed Guide to Enactment text accordingly.

As regards paragraph (1) ter, it was noted that " accessibility standards " as they apply to the submission of tenders could be accommodated in article 30 of the Model Law.

The alternative text for " accessibility standards " (see para. 30 above), as redrafted, could either replace paragraph (1) quater, or could be located elsewhere in the text.

It was further observed that the formulation of the " accessibility standards " and proposed article 9, paragraph (1) quater, should be considered in the context of proposed article 9, paragraph (1) quinquiens.
39- ولوحظ كذلك أن صيغة " معايير سهولة المنال " وصيغة الفقرة (1) مكررا ثالثا من المادة 9 المقترحة، ينبغي أن ينظر فيهما في سياق الفقرة (1) مكررا رابعا من المادة 9 المقترحة.

Nonetheless, the Working Group recognized that article 11 addressed the storage but not the dissemination of information, and therefore requested the Secretariat to consider how to include this broader concept in the accessibility standards that it had requested the Secretariat to draft (see paras. 25 and 32 above).

As to the third element, it was recalled that the controls concerned were the " accessibility standards " that the Working Group decided at its seventh session should apply to the means of communication chosen (A/CN.9/575, para. 14).

Accordingly, it was proposed that the text should state " provided that such use complies with the [accessibility standards] " , a purely objective standard, and that the issue of requiring the procuring entity to record its selection of the means of communication should be revisited when the Working Group considered the formulation of the " accessibility standards " .
