24. While noting that the information provided on the current negotiation process between the European Community and the State party on readmission agreements, the Committee is concerned at the lack of procedural guarantees for migrant workers.

While the Committee takes note of articles 148 and 151 of the Constitution of the State party, it is concerned that the exact status of the Convention in domestic law remains unclear and regrets the lack of information, including examples, on the application of the Convention's provisions by the domestic courts.

While taking note of the Maori Strategic Plan developed by the Department of Corrections, as well as the various initiatives undertaken by the Ministry of Justice to reduce Maori offending, the Committee is alarmed at the disproportionately high number of Maoris and Pacific Islands people incarcerated, in particular women who, according to information available to the Committee represent 60 per cent of the female prison population.

While taking note of the assurances by the State party whereby tasers are only to be used by trained and certified staff and only when the officer has an honest belief that the subject is capable of carrying out the threat posed and that the use of the taser is warranted, the Committee is deeply concerned about the introduction of these weapons in the New Zealand police.

While taking note that, according to the delegation, migrant workers have equal rights with citizens of Azerbaijan, the Committee is concerned at information that migrant workers, in particular undocumented and irregular migrant workers, and members of their families, may in practice suffer from various forms of discrimination, in particular in the area of employment, education, and housing.
24- مع أن اللجنة تحيط علماً بأن العمال المهاجرين متساوون مع مواطني أذربيجان في الحقوق، حسب ما قاله الوفد، فإنها تشعر بالقلق إزاء ما وردها من معلومات تفيد أن العمال المهاجرين وأفراد أسرهم، وخاصة منهم من لا يحملون وثائق رسمية ومن هم في وضع غير قانوني، قد يعانون في الواقع العملي من أشكال مختلفة من التمييز لاسيما في مجالات التوظيف والتعليم والسكن.

88. While taking note of the State party efforts to address the economic exploitation of children, the Committee remains concerned that the global financial crisis has had a negative impact on children in the State party, and families have sought new survival strategies such as the involvement of children in hazardous work and/or migration and trafficking for labour exploitation purposes.

While noting that the State party amended its Criminal Code in 2005 in order to bring the definition of torture into conformity with the provisions of the Convention, the Committee regrets that the definition contained in article 127 of the Criminal Code does not fully reflect all elements contained in article 1 of the Convention, notably with respect to discrimination.

15. While noting that a bill on protecting human rights defenders, journalists, social communicators and justice officials has been drafted, the Committee regrets that human rights defenders, especially indigenous and Afro-Honduran leaders, continue to be subject to serious physical assault.

10. While noting that the Convention, its Optional Protocol and the Committee's general recommendations have been translated into Hungarian, the Committee remains concerned about the lack of awareness among the legal profession and women themselves about the Convention.

Redress While noting that many dioceses and religious orders provided financial settlements to victims of abuse, the Committee remains deeply concerned at the reported inability to obtain redress experienced by many alleged victims of violations of the Convention perpetrated by or with the acquiescence of persons acting in an official capacity for the State party.
