The Committee is concerned at the lack of implementation of the existing provisions due to various factual constraints and the lack of an effective juvenile justice system of specialized prosecutors, judges and social workers to deal with children in conflict with the law.

However, it is also clear that many States parties still have a long way to go in achieving full compliance with CRC, e.g. in the areas of procedural rights, the development and implementation of measures for dealing with children in conflict with the law without resorting to judicial proceedings, and the use of deprivation of liberty only as a measure of last resort.
غير أنه من الواضح أيضاً أن المشوار لا يزال طويلاً أمام العديد من الدول الأطراف لتحقيق الامتثال الكامل لأحكام الاتفاقية، كما هو الشأن على سبيل المثال في مجالات الحقوق الإجرائية، ووضع وتنفيذ تدابير للتعامل مع الأطفال المخالفين للقانون دون اللجوء إلى الإجراءات القضائية، وعدم استخدام الحرمان من الحرية إلا إذا كان ذلك تدبيراً يتخذ كملاذ أخير.

27. It is left to the discretion of States parties to decide on the exact nature and content of the measures for dealing with children in conflict with the law without resorting to judicial proceedings, and to take the necessary legislative and other measures for their implementation.
27- ويُترك للدول الأطراف أمر البت في الطبيعة والمضمون الحقيقيين لتدابير التعامل مع الأطفال المخالفين للقانون دون اللجوء إلى الإجراءات القضائية، واتخاذ التدابير التشريعية اللازمة وغيرها من أجل تنفيذها.

At the same time, the juvenile justice system should provide for ample opportunities to deal with children in conflict with the law by using social and/or educational measures, and to strictly limit the use of deprivation of liberty, and in particular pretrial detention, as a measure of last resort.
وفي الآن ذاته، ينبغي لنظام قضاء الأحداث أن يتيح فرصاً شتى للتعامل مع الأطفال المخالفين للقانون باللجوء إلى تدابير اجتماعية و/أو تعليمية وتقييد استعمال الحرمان من الحرية تقييداً صارمـاً، لا سيما الاحتجاز قبل المحاكمة، بحيث لا يتم إلا كملجأ أخير.

Other appropriate assistance is possible (e.g. social worker), but that person must have sufficient knowledge and understanding of the various legal aspects of the process of juvenile justice and must be trained to work with children in conflict with the law.
