The invalidity of a unilateral act which is contrary to a peremptory norm of international law derives from the analogous rule contained in article 53 of the 1969 Vienna Convention on the Law of Treaties.

Furthermore, it was also stated that a distinction must be made between cases of invocation of invalidity of unilateral acts and cases in which an act was void because it conflicted with a peremptory norm of international law.

The cause of invalidity relating to a unilateral act that conflicts with a peremptory norm of international law -- a question which arose in the International Law Commission in 1966 and which elicited an interesting debate at the Vienna Conference of 1968-1969 -- was included in paragraph 6 of former article 7.

25. Articles 53 and 64 of the Vienna Conventions established that States could not conclude a treaty that conflicted with a peremptory norm of general international law; draft guideline 3.1.9 could therefore be interpreted as a necessary implication of that principle.

139. A unilateral act is also void if it is contrary to a State’s own previous norms or to a peremptory or jus cogens norm, the latter being understood as a norm accepted and recognized by the international community, as stated in the 1969 Convention.
