6.4 As to the alleged failure to substantiate the communication in respect of the complaint under article 14, paragraph 5, the Committee found that the author had sufficiently substantiated this part of the communication for the purposes of its admissibility and concluded that the communication was admissible in respect of the alleged lack of a full review in cassation of the sentence handed down by the Provincial Court.

12.5 The Committee against Torture consequently decided that the communication was admissible with regard to article 2, paragraph 1, taken in conjunction with article 1, or, alternatively, article 16, paragraph 1; and articles 11, 12, 13 and 14, taken separately or in conjunction with article 16, paragraph 1 of the Convention.

Taking into account this delay, the nature of the offence, and the absence of elements which would have complicated the investigations and judicial proceedings, as well as the absence of an explanation by the State party concerning the delay of such proceedings, the Committee concludes that the communication is admissible with regard to a possible violation of article 14, paragraph 3 (c), of the Covenant.
وبالنظر إلى ذلك التأخير، وطبيعة الجرم وعدم وجود عناصر من شأنها تعقيد التحريات والإجراءات القضائية، تخلص اللجنة إلى أن البلاغ مقبول فيما يتعلق باحتمال وقوع انتهاك للفقرة 3(ج) من المادة 14 من العهد.

Accordingly, the Committee concludes that the State party has not demonstrated the existence of effective remedies to be exhausted, and that for these authors the communication is admissible with reference to article 5, paragraph 2 (b), of the Optional Protocol.
