She therefore proposed that the phrase " without being obliged to disclose the identities of the other bidders " should be added at the end of the model provision.
ومن ثم اقترحت إضافة عبارة " دون أن تكون السلطة المتعاقدة ملزمة بالكشف عن هوية مقدّمي العروض الآخرين " في نهاية هذا الحكم النموذجي.

He therefore proposed that some such wording as " which it may do without having to negotiate with all the remaining bidders " should be added at the end of the penultimate sentence of paragraph 2.
واقترح من ثم إدراج مثل عبارة " ويجوز لها ذلك دون أن تتفاوض مع كافة من بقي من مقدّمي العروض " في نهاية الجملة قبل الأخيرة من الفقرة 2.

Mr. Bouwhuis (Observer for Australia) asked whether the penultimate sentence of paragraph 2 meant that a contracting authority was required to negotiate with all of the remaining bidders.
33- السيد بوهويس (المراقب عن أستراليا): سأل ما اذا كانت الجملة قبل الأخيرة من الفقرة 2 تعني أن السلطة المتعاقدة ملزمة بالتفاوض مع جميع مقدّمي العروض الآخرين.

Mr. Estrella Faria (Secretariat) said that the Working Group's intention had been that the contracting authority could choose how many bidders on its list it wished to negotiate with.
34- السيد إستريلا فاريا (الأمانة العامة): قال إن نية الفريق العامل اتجهت نحو تمكين السلطة المتعاقدة من أن تختار من القائمة عدد مقدّمي العروض الذين ترغب في التفاوض معهم.

Mr. Bouwhuis (Observer for Australia) said he would welcome a clarification in the text to show that the contracting authority need not work its way through an entire list of bidders.
38- السيد بوهويس (المراقب عن أستراليا): قال إنه سيرحّب بإدراج ما يوضّح في النص أن السلطة المتعاقدة لا تحتاج إلى التفاوض مع كافة مقدّمي العروض المدرجة أسماؤهم على القائمة.

In connection with that amendment, the point was made that, in order to preserve the anonymity of bidders, the results of the full evaluation of initial bids should be communicated individually and simultaneously to each supplier or contractor concerned, but in order not to prejudice the legitimate commercial interests of the parties or to inhibit subsequent fair competition, only to the extent relevant to each such supplier or contractor.
واقترانا بذلك التعديل، أفيد بأنه من أجل إبقاء هوية مقدّمي العروض طي الكتمان، ينبغي أن يُبلَغ كلُّ المورّدين أو المقاولين المعنيين فرديا وفي آن واحد بنتائج التقييم الكامل للعروض الأوّلية، حرصا على عدم المساس بما للأطراف من مصالح تجارية مشروعة أو عرقلة المنافسة العادلة التي يمكن أن تلي الدعوة، على ألاّ يكون ذلك إلاّ في الحدود التي تخص كل مورِّد أو مقاول.

Ms. Veytia Palomino (Mexico) said that, even in a system under which the identity of the bidders was known, it was desirable to avoid disclosing the originator of a request for clarification, since bidders, knowing who their competitors were, would be reluctant to show their own hands.
7- السيدة فيتيا بالومينو (المكسيك): قالت إن من المستصوب، حتى في حالة وجود نظام يقضي بكشف هوية مقدّمي العروض، ألاّ تُكشف هوية أصحاب طلبات الحصول على إيضاحات لأن مقدّمي العروض سيعزفون عن الكشف عن توجهاتهم لدى علمهم بهوية منافسيهم.

On the other hand, the list of those to whom information could be disclosed was too restrictive: the list could also include co-bidders in the consortium, affiliates of the bidder or government agencies.
ومن ناحية أخرى فإن قائمة الأطراف التي يمكن أن تُكشف لها المعلومات جاءت تقييدية أكثر مما يلزم رغم أنه يمكن لها أن تشمل مقدّمي العروض الذين ينتمون إلى نفس الكونسورتيوم أو المؤسسات الفرعية التابعة لمقدّم العرض أو الوكالات الحكومية.
