Since the source has not addressed the question of a potential impact of the situation of Mr. Georgiou on the possibility of his early release in its communication submitted to the Working Group and has failed to comment on the observations of Government and to contest them, the Working Group considers that it is lacking sufficient information to conclude that the detention of Mr. Georgiou is of an arbitrary nature.
33- وبالنظر إلى أن المصدر لم يتناول مسألة أثر وضع السيد جورجيو المحتمل على إمكانية الإفراج المبكر عنه في بلاغه المقدّم للفريق العامل ولم يُعلق على ملاحظات الحكومة أو يطعن فيها، فإن الفريق العامل يعتبر أنه يفتقر إلى المعلومات الكافية لاستنتاج أن احتجاز السيد جورجيو ذو طبيعة تعسفية.

31. The observations of the Government were transmitted to the source, which has not commented on them, despite having been invited to do so.

16. The source, in a letter dated 17 November 2006, informed the Working Group that the lawyers of Mr. Iskandarov have not produced any material to comment on the observations of the Government.

7.2 The complainant notes that the observations of the Government of France do not mention that he appealed against the latest decision of OFPRA on 3 August 2006 before the National Asylum Court (the new name of the Refugee Appeals Board) and that a decision on this appeal is imminent.

23. In its comments to the observations of the Government, the source provided the following information: Regarding the statement by the authorities that the detention of the members of this group was based, at least partly, on their own confessions, the source emphasized that all the defendants denied the charges and told the Supreme State Security Court (SSSC) in November 2006 that they had been tortured while detained.

It observed that the Government's observations did not in reality challenge several of the allegations contained in paragraphs 7 to 9 of the Opinion: that no arrest warrant was shown, and that eyewitnesses at the scene of the incident leading to Mr. Ramírez Soto's arrest confirmed that he was not carrying a firearm.

16. In replying to the Government's observations, the source informs that, as of 8 November 2005, the three men remain in detention, while the Government continues to state that it is awaiting the files concerning their cases from the United States authorities.
