In the absence of any observations on the admissibility and merits of the communication from the State party, due weight must be given to the author's allegations, to the extent that these have been sufficiently substantiated.
ونظراً إلى أن الدولة الطرف لم تبد أي ملاحظات بشأن مقبولية البلاغ وأسسه الموضوعية، فإنه يجب إيلاء ادعاءات صاحب البلاغ الاعتبار اللازم في حدود استنادها إلى الأدلة الكافية.

4.1 The State party submitted observations regarding the admissibility of the communication in a note verbale dated 28 January 2008 in which it stated that the communication should be declared inadmissible.
4-1 قدمت الدولة الطرف ملاحظات بشأن مقبولية البلاغ في مذكرة شفوية مؤرخة 28 كانون الثاني/يناير 2008 قالت فيها إنها ترى ضرورة إعلان عدم مقبولية البلاغ.

5-3 وفيما يتعلق بشرط استنفاد سبل الانتصاف المحلية، تكرر اللجة قلقها من عدم تلقي أي معلومات أو ملاحظات بشأن مقبولية البلاغ أو أسسه الموضوعية من الدولة الطرف رغم توجيه اللجنة لثلاثة تذكيرات إلى الدولة الطرف.
