(c) By a public servant using his official position or by a person exempt from customs control;
(ج) من قـِـبـل موظف حكومي يستغل منصبه الرسمي أو من قـِبـل شخص معفـى من التفتيش الجمركي؛

(a) By a person to whom weapons, ammunition, explosive substances or explosive devices were entrusted in connection with his official position or under his protection;

The above procedures and mechanisms, in the view of the Secretary-General, implement the obligation to provide an appropriate means of dispute resolution in respect of disputes arising out of contracts or other disputes of a private law character or involving any official of the United Nations who by reason of his official position enjoys immunity that has not been waived by the Secretary-General.
٣٣ - يرى اﻷمين العام أن اﻹجراءات واﻵليات المذكورة أعلاه تنفذ الالتزام بتوفير اﻷساليب المناسبة لتسوية النزاعات الناشئة عن العقود وغيرها من النزاعات المشمولة بالقانون الخاص أو التي يكون طرفا فيها أي موظف من موظفي اﻷمم المتحدة يتمتع بحكم منصبه الرسمي بالحصانة، ما لم يكن اﻷمين العام قد رفع هذه الحصانة.

(b) Disputes involving any person referred to in the present Agreement who, by reason of his or her official position or function in connection with the Court, enjoys immunity, if such immunity has not been waived.
(ب) المنازعات التي يكون طرفا فيها أي شخص مشار إليه في هذا الاتفاق يتمتع بالحصانة بحكم منصبه الرسمي أو مهمته الرسمية فيما يتصل بالمحكمة، إذا كانت هذه الحصانة لم ترفع عنه.

(b) Disputes involving any person referred to in the headquarters agreement who, by reason of his or her official position or function in connection with the Court, enjoys immunity, if such immunity has not been waived.
(ب) المنازعات التي تشمل أي شخص يشار إليه في اتفاق المقر ويتمتع بالحصانة، بحكم منصبه الرسمي أو وظيفته فيما يتصل بالمحكمة، إذا كانت هذه الحصانة لم ترفع عنه.

85. These acts committed by an individual in abuse of his or her official position are punishable by a fine of from 500 to 700 times the monthly notional unit or deprivation of liberty for up to 3 years, with or without forfeiture of the right to occupy certain positions or engage in certain activities for the same period.
85-ويعاقب الشخص الذي يرتكب الأفعال المشار إليها أعلاه من خلال استغلال منصبه الرسمي بغرامة تتراوح بين 500 و700 مرة قدر مؤشر حساب المرتب الشهري، أو بالسجن مدة تصل إلى ثلاث سنوات مع الحرمان من الحق في شغل مناصب محددة أو الاشتغال بأعمال معينة لفترة مماثلة، أو بدون حرمان.

Both sections 320 and 323 CL make reference to the performance of acts or failure to perform an act by a public official " using his or her official position " , in compliance with the term " in the exercise of duties " used in article 15 of the Convention against Corruption.
