ومن حق كل فرد، لدى الفصل في أية تهمة جزائية توجه إليه أو في حقوقه والتزاماته في أية دعوى مدنية، أن تكون قضيته محل نظر منصف وعلني من قبل محكمة مختصة مستقلة حيادية، منشأة بحكم القانون.
