Under agenda item 5, Mr. Manfred Nowak summarized his report on the existing international criminal and human rights framework for the protection of persons against enforced or involuntary disappearances and answered many questions raised by participants.
25- بموجب البند 5 من جدول الأعمال، لخّص السيد مانفريد نواك تقريره المتعلق بالإطار الدولي القائم في المجال الجنائي ومجال حقوق الإنسان من أجل حماية الأشخاص من الاختفاء القسري أو غير الطوعي وأجاب على الأسئلة العديدة التي طرحها المشاركون.

It also establishes the inadmissibility of any proceedings brought by any individual or group against members of any branch of Algeria's defence and security forces for actions undertaken to protect persons and property, safeguard the nation and preserve its institutions.
كذلك ينص هذا الأمر على عدم جواز الشروع في أي ملاحقة فردية أو جماعية في حق أفراد قوات الدفاع والأمن الجمهورية، بجميع أسلاكها، بسبب أعمال نُفذت من أجل حماية الأشخاص والممتلكات والإبقاء على وحدة الأمة والحفاظ على مؤسسات الجمهورية.

The last line of this provision clearly establishes that any charge or complaint filed against State officials for actions undertaken to protect persons and property, safeguard the nation and preserve the institutions of the People's Democratic Republic of Algeria are automatically deemed inadmissible.

In this respect, there is a need to revisit the concepts of " rehabilitation " and " re-education " , as well as of " corrective " and " correctional " , among others, in order to protect persons deprived of liberty from arbitrary intervention or treatment that may amount to torture or other ill-treatment.
