27- وعلى الدولة الطرف بموجب المادة 14 أن تضمن إنصاف ضحايا أي عمل من أعمال التعذيب أو سوء المعاملة خاضعين لولايتها القضائية.

States must carry out a prompt and impartial investigation wherever there is a reasonable ground to believe that an act of torture or ill-treatment has been committed.
ويتعين على الدول إجراء تحقيق سريع ونزيه كلما وُجدت أسباب معقولة تدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب أو إساءة المعاملة قد ارتكب().

Article 10, paragraph 3: Any persons, agents of the State or persons vested with public authority who commit an act of torture or cruel and inhuman treatment, whether at their own initiative or under orders shall be punished in accordance with the law.
الفقرة 3 من المادة 10: " يُعاقب وفقاً للقانون كل فرد أو موظف في الدولة أو سلطة عمومية يتورط في عمل من أعمال التعذيب أو المعاملة القاسية واللاإنسانية، سواءً أمن تلقاء نفسه أو بإيعاز من الغير " .

The State party submits that this cannot be considered an “act” of torture or cruel, inhuman or degrading treatment or punishment within the meaning of the Convention and that the Convention was not intended to nor does it apply to such circumstances.
وتدفع الدولة الطرف بأن هذا لا يمكن اعتباره " عملا " من أعمال التعذيب أو المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، في حدود المعنى الوارد في الاتفاقية، وأن الاتفاقية لا تسري على هذه الحالات ولم يكن القصد منها كذلك.

21. On the basis of this article and related article 16, the State must ensure that its competent authorities proceed to a prompt and impartial investigation when there is reason to believe that under its jurisdiction an act of torture or cruel, inhuman or degrading treatment or punishment has been committed.
21- بمقتضى هذه المادة والمادة 16 التي لها صلة بها، يجب على الدولة أن تكفل قيام سلطاتها المختصة بإجراء تحقيق فوري ونزيه عندما يكون هناك ما يدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب أو المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة ارتُكِب في الأراضي الخاضعة لولايتها.

13.7 The Committee observes that in the case of an allegation of torture or cruel, inhuman or degrading treatment having occurred, the right to remedy requires, after the event, an effective, independent and impartial investigation of such allegations.
13-7 وتلاحظ اللجنة أنه في حالة الادعاء بحدوث عمل من أعمال التعذيب أو المعاملة القاسية أو اللاإنسانية أو المهينة، فإن الحق في سبيل انتصاف يقتضي، بعد وقوع الحدث، فتح تحقيق فعلي ومستقل ونزيه في تلك الادعاءات.

3. Any act of torture or other cruel, inhuman or degrading treatment or punishment is an offence to human dignity and shall be condemned as a denial of the purposes of the Charter of the United Nations and as a violation of the human rights and fundamental freedoms proclaimed in the Universal Declaration of Human Rights.
3- يُعتبر أي عمل من أعمال التعذيب أو المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة جريمة حاطة من كرامة الإنسان ويتعين التنديد به باعتباره إنكاراً للأغراض التي يرمي إليها ميثاق الأمم المتحدة وانتهاكا لحقوق الإنسان والحريات الأساسية المنصوص عليها في الإعلان العالمي لحقوق الإنسان.

21- بمقتضى هذه المادة والمادة 16 ذات الصلة بها، يجب على الدولة أن تكفل قيام سلطاتها المختصة بإجراء تحقيق فوري ونزيه عندما يكون هناك ما يدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب أو المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة ارتُكِب في الأراضي الخاضعة لولايتها.

101. As part of the supervisory mechanism of detention centres and the human conditions of detainees, Moroccan law has granted the judicial authorities powers to ensure that detention conditions are humane, and to prevent the commission any act of torture or degrading treatment.
101- ولمراقبة وضعية السجناء بمراكز الاعتقال والوقوف على الظروف الإنسانية التي تتمتع بها هذه الفئة، أسند القانون المغربي للسلطة القضائية صلاحية تتبع والتأكد من أنسنة ظروف الاعتقال بما يفترضه ذلك من منع حدوث أي عمل من أعمال التعذيب أو سوء المعاملة المهينة أو المحقرة من كرامة الإنسان.
